guess what? after all the post 911 stuff, that's now illegal. i believe it falls under "making terroristic threats". call the police and press charges.

slip a shiv into his kidney when hes not looking, that will show him who the real boss is.

I think you're really lucky he threatened you rather than fired you. You would have no recourse when fired since you were way outta line. At least this way, you're in the right. He shoudln't have threatened you.

good thing u dont live in the states....that way i dont have to deal with arseholes on power trips like you

Make sure you make it out of acrylic and weaken where the shiv is attached to the handle so you can break the shiv off while it is in him. This will make it so he can not remove the shiv.

Can of Petrol, couple of matches in case one breaks (perhaps a lighter for reliability?), snag his address from the office, problem solved.

Making terroristic threats has been illegal in many areas long before 9/11. But the fact of the matter is that without witnesses or proof to back you up, you won't get very far pressing charges. If the regional manager backs up the manager, then it's GoodDad's word against theirs and the charges would be dismissed quite quickly.

I have to agree. If i spent $15k on a setup then found out they sold MY TV out from under me and they didnt have onother in stock i would raise heck. I would also get my money back and go someplace else.

There are plenty of other places that would treat me right when im dropping 15k

Exactly! Goodguy, maybe in hindsight you should have let him sell it and have him deal with the customer when they came to get it.

I'd be damned if my boss talks to me like that.

You should start looking for another job. And if you do find a job tell them that you can start that weekend. That way if you do have to work weekends at that crappy job you won't show up and screw them over.

Tell the person that you sold the TV to that your boss resold it to someone else and that they should file a criminal complaint

Both great suggestions!

Seriously, what you should do is talk to a lawyer. MANY will talk to you for free. Tell them about anyone that heard him yelling. Even if they didn't actually hear him say, "I'll kill you," it would give you creedence to your story. The lawyers will be able to tell you if you have a case or not, they could tell you if you can legally record him without him knowing in your state, and they could tell you what steps to take next. And yes, a written log is a GREAT idea. VERY effective and admissible in court. Also, make sure to keep notes and/or photocopies of your timesheets. He may try to fire you and come up with a good reason, so you'll want to be able to prove that it was related to this.

I actually think you have a better case than you think you do. Here's what I gather:

- He couldn't deny that you already made the sale
- You could go and get records to prove that you sold the only one of that specific TV in the store at the time
- If you can get ahold of the people that he was talking to at the time (I don't know if this is possible or not), you could prove that he was making the claim to them that they had a TV in stock and they didn't
- Other employees could prove that he was yelling profusely at you
- The lack of any disciplinary action against that manager and the prescence of the regional manager could actually benefit you since it would not just be your manager that was in the wrong. However, in order to get proof or lack-thereof of corrective action against your boss, you'd have to get a lawyer with a court subpoena for the company's records.

In essence, the only thing that would be your word against his would be the actual "I'll kill you" line, and given the rest of the facts, that wouldn't be that hard to prove I wouldn't think. But again, you should consult a lawyer - and soon - about this just to see what your options are. I'd look for a lawyer that deals with these kinds of claims so that they'll be familiar with cases like yours. I'm sure it happens often enough (LOTS of sh*tty bosses out there) that they would be able to tell you right off the top of their head what you should do.

AIWGuru, you're an idiot. I hope you read this thread. First off, working in 100% commission means that they're their own boss in some respects. It is VERY much every man for himself in that instance. His boss can't just take sales away from him. Not only would he lose that sale, but any references (rich references from those particular customers I'd bet) as well. Plus, what the boss wanted to do does border on criminal, though I tend to agree with you that they probably were, legally, able to do whatever they wanted with it since posession is 9/10ths of the law. The bottom line is, taking this sale from that employee would have been illegal. If you're paying people 100% commission, there are rules about how you can treat them. It's that simple.

Get a recorder. Record this up when it happens next time. (Oh, it will happen again, don't worry.) Then sue. This is bull.

If that doesn't work, vandalism is the great equalizer.

I can do way worse damage than vandalism, but I dont want to stoop to their level.

As far as the recorder, my cell phone does have one built in. But I dont know if I want to deal with all this until it does happen again.

why not? you keep your job, get your boss pissed, get it on recording, sue the store/him, make away with some fast cash and find yourself another job. imo suffering would be well worth a 10k settlement :)

Never been threatened with my life, but I have been threatened with my job. (quit the very next day and found a better job)

I think you did the right thing, GoodDad. The only other thing I would have done in your place is goto HR.

Good luck!

anyone get the feeling that AIWGuru never held down a real job or only had jobs where he's at the menial level?

for commission work, what you earn is your lifeblood, I did that for about a summer and I wouldn't want to go back there ever, it's truly everyman for himself no matter what level you are at.
