Seriously, what you should do is talk to a lawyer. MANY will talk to you for free. Tell them about anyone that heard him yelling. Even if they didn't actually hear him say, "I'll kill you," it would give you creedence to your story. The lawyers will be able to tell you if you have a case or not, they could tell you if you can legally record him without him knowing in your state, and they could tell you what steps to take next. And yes, a written log is a GREAT idea. VERY effective and admissible in court. Also, make sure to keep notes and/or photocopies of your timesheets. He may try to fire you and come up with a good reason, so you'll want to be able to prove that it was related to this.
I actually think you have a better case than you think you do. Here's what I gather:
- He couldn't deny that you already made the sale
- You could go and get records to prove that you sold the only one of that specific TV in the store at the time
- If you can get ahold of the people that he was talking to at the time (I don't know if this is possible or not), you could prove that he was making the claim to them that they had a TV in stock and they didn't
- Other employees could prove that he was yelling profusely at you
- The lack of any disciplinary action against that manager and the prescence of the regional manager could actually benefit you since it would not just be your manager that was in the wrong. However, in order to get proof or lack-thereof of corrective action against your boss, you'd have to get a lawyer with a court subpoena for the company's records.
In essence, the only thing that would be your word against his would be the actual "I'll kill you" line, and given the rest of the facts, that wouldn't be that hard to prove I wouldn't think. But again, you should consult a lawyer - and soon - about this just to see what your options are. I'd look for a lawyer that deals with these kinds of claims so that they'll be familiar with cases like yours. I'm sure it happens often enough (LOTS of sh*tty bosses out there) that they would be able to tell you right off the top of their head what you should do.
AIWGuru, you're an idiot. I hope you read this thread. First off, working in 100% commission means that they're their own boss in some respects. It is VERY much every man for himself in that instance. His boss can't just take sales away from him. Not only would he lose that sale, but any references (rich references from those particular customers I'd bet) as well. Plus, what the boss wanted to do does
border on criminal, though I tend to agree with you that they probably were, legally, able to do whatever they wanted with it since posession is 9/10ths of the law. The bottom line is, taking this sale from that employee would have been illegal. If you're paying people 100% commission, there are rules about how you can treat them. It's that simple.
