at no time did she do anything to warrant being sprayed or arrested. it is not that cops job to teach her a lesson. now if she touched him thats a different story but she stayed away from him and just yelled at him.


she's 16 and working a minimum wage job. she's not doing it for fun. the cop rolled by and harassed her and accused her of being a thief when she did nothing wrong. she had every reason to be upset and i don't fault her at all for it.

Judge upholds rehiring of cop who sprayed girl
DAYTON, Ohio ? A judge has upheld the reinstatement of a policeman fired after using pepper spray on a worker at a fast-food restaurant.

Montgomery County Common Pleas Judge Jeffrey Froelich ruled Monday that the city is bound by an arbitrator's order to rehire policeman Michael McDonald.

City officials are considering whether to pursue the case, spokesman Tom Biedenharn said Tuesday.

Officer McDonald used pepper spray on Brandy Martin, then 17, while arresting her in February 1998. He said she refused to go with him to his cruiser and receive a summons after he accused her of shortchanging him at the drive-through window.

Officer McDonald, 35, was found not guilty of misdemeanor assault in June 1998. But Police Chief Ronald Lowe fired him a few weeks later, saying OfficerMcDonald's actions were callous and brutal.

She has the legal right to tell the cop to STFU. He didn't have the legal right to arrest her, especially when he was in the wrong.

The court knew this, and that's why she got $60,000.

I think that most agencies spray the cadets as part of academy.
Edit: I know that the police depts in AZ and the FBI do anyway.

and how in the hell was he found not guilty of assault? there is video of the whole thing.

Since he's still on the force, it appears he is above the law.

It just goes to show that if you want to break the law, join the force!

True, but this was more of a personal matter than a law enforcement issue. If that were to happen to me, I can not tell the person to get in my car and I am taking them to jail. He abused his position and power for a trival personal matter.

EDIT: Yes she had an attitude and was rude. But he took it much to far.

i wonder what went through the cops mind later on that day when he got home emptied out the contents of his pants and found the 20 in his other pocket

I make a point of not hating "cops" outwright, because You never know when you might need one... And also, I'm sure that the whole attitude of, "F*ck the police" Is the result of some bad-apples spoiling the whole bunch...

I do tend to have a feeling that because of the power involved, policework tends to have more "Bad Apples" than other proffessions, this is definitly a good example...

I'm under the impression that the case was settled out of court for $60,000, I would have gone for more, but If there was any way I could permanantly garuntee he would never wear a badge again, I would have given the money up...

No. She did nothing wrong. She was obviously upset but that only took place AFTER the cop came into the back on his own. This is AFTER the mgr told him that he was mistaken.

The fact that this happened in Dayton has nothing to do with it. Here in NYS cops rarely get disciplined for abusing power, putting others in danger or even committing minor offenses themselves. What probably happened in this case is the same thing that happens anywhere (in the U.S.) that cops do the wrong thing. - There is an "internal investigation" and things just blow over. and that's that.

Oh, and the same holds true for relatives of cops. They protect their own.
 

Well since that little fungod.com tag was on the video the whole time I have no idea whats going on.

:D ...and don't even get me started about the drugs and hookers. In my neck of the woods some local cops have a good deal going where they're given drugs by the dealers and then proceed to have hot tub parties where the goods are generously distributed to the hookers for "favors".

looked like a moment right out of super troopers...can we say Rod Farva. He should have been fired, what a jerk...next time I think I'm short changed, I'm walking back there, makin a citizen's arrest and pepper sprayin the person running the drive through...after all it's my right.....right?
