In the civil lawsuit, the woman who is now 20, claims that when ?she was bent over the chair and forced by defendant Bryant to remain in that position, defendant Bryant sexually assaulted and raped plaintiff, by unlawfully and knowingly inflicting sexual intrusion and penetration of her vagina against her will and without her consent.?

I knew it from the beginning. I had a sneaking suspicion that Kobe (without the slightest criminal history) would never do a thing of this sort (sexual assault / rape). When some details came out about the night of question and we found out more about his accuser, it only strengthened my opinion. It was amusing though to see all these asses between now and then who didn't know a thing about the case come on 'x' message board and boldly predict and wish for Kobe's future to lie in prison. :roll:

For those who have been following the case, this isn't of the slightest surprise. The DA knew the DNA evidence did NOT support her allegations as early as three weeks after the scandal broke... yet he proceeded to charge Kobe with this serious crime. Since then, the prosecution (which should be looking for the truth) has worked to supress this irrefutable DNA evidence... which in a he said/she said case such as this, is the only objective way to re-create the events before, during and after the supposed crime. Lest we forget how she sponged off the Colorado Victims Compensation fund to visit expensive drug rehab centers and party it up in Canada, etc., etc., etc.....

This mess should've never happened. Stupid Kobe... and lying, crazy, filthy, criminal b!tch!!! :|

No way friend. She could have had a fair trial had her behavior not come out into the press. I remember PMing the mods and begging them to delete links to her yearbook photos and name. However, then it came out the numerous people she had sex with, her mental problems, drug abuse, etc. That destroyed her credibility, and suddenly the burden of proof was on her. It is innocent until proven guilty in the US, and what has proved Kobe guilty? You have a mentally unbalanced teenager that loved to have promiscuous sex, and also an individual that had traces of OTHER semen on her when she had a rape-kit. Not only that, but why did she go into his room? If she felt uncomfortable she could of had someone else go, or have an escort go with her. I don't feel sorry that Kobe's rep was destroyed, but no one should have rape charges just leveled against them at the bequest of a total psycho.

Finally, someone said that there were numerous reasons for filing a civil suit. LOL! What reasons other than money? In a criminal case you have to prove beyond a reasonable doubt that he raped her. In a Civil Case you just have to prove your case with a preponderance of evidence. Obviously they don't have the evidence to criminally convict him(which to me means that rape didn't happen), so she is trying to get his money. Did anyone NOT think that was her motive once we found out she was a psycho? People(including myself) called this from a long time ago. Even if he was not-guilty I KNEW just KNEW that she would sue him civilly. She's after the money...

No, it isn't. No one has to prove their innocence. The US Criminal Justice system requires that a prosecutor prove GUILT, and not that a defendant prove innocence.

his lawyers don't have to prove his innocence, they just have to disprove the prosecutions case. not the same thing.

hence the presumption of innocence.

Can someone explain to a layman why you are allowed to sue both criminally and civilly on the same case in the current legal system? I can't see any possible advantages to this.

We aren't on the jury, so thats not even relevant. Regardless, we have formed our opinions based on what has been presented to us in a similar way to that of a jury. To me, this thing just doesn't add up.

Kobe, as a successful rich basketball player is a fvcking tail magnet...if this girl weren't willing, there would be another one right around the corner. On the other hand, he has EVERYTHING to lose by doing something stupid like raping a girl...his wife, his career because if he was sent to jail in his prime he'd lose a lot of that, his image of course. It just doesn't make sense.

The girl on the other hand, has a plausible motive for false accusations...money. And false accusations are more common than you might think. You don't hear about those...you see "so and so is on trail for rape" and a couple months later maybe a news brief on the back page of the paper saying he was found innocent....if the guy even gets that. Its a sad state of affairs when women do this, because it undermines the prosecution in tons of other cases where the woman really was raped. Not trying to defend rapists here...but just because you're accused of something doesn't mean you did it.

So to start with, the situation just doesn't add up...but that isn't everything...crime doesn't always make sense. But then we have the girl abandoning the criminal suit for the more lucratic civil suit...which just comes off as a pure money grab to me and really she's showing her hand with this. The civil suit is easier to win and is almost garenteed a cash payout...Kobe will most likely just throw money at the problem and settle out of court to get the sh|t over with. Its a waste of his time to deal with it. Doesn't reflect well on the girl.
