So does the HGN and VGN stuff hold up in court? What if you were doing drugs and the only sign of intoxication was a failed VGN? That is crazy that the movement of your eyes can have so much legal weight.

The court will consider the totality of the circumstances and evidence presented. Any individual test is just 1 element in proving that a crime did infact occur.

The officer in this case would testify that the underage individual came ouf tthe club and admitted to doing so, smelled of alchohol, had alchohol on his shirt, probably exhibited slurred speech, other behaviors indicative of alchohol, and can top it off with the HGN test.

Totality of circumstances.

That's why it isn't the only sign that is used to judge intoxication. In most states, at least 3 different indicators of intoxication must be used to establish a person as being intoxicated during a DUI arrest. For something like PI or UC, the guidelines may be different. In the OP's case, HGN + Alcohol on the breath + slurred speech (maybe) + glassy eyes + admitting to being in a club underage + probably other things.

Fill in the blank - I left a club drunk (Im under 21) and these 2 girls invited me to their dorm and then I got stopped on the street by a cop who started questioning me, I made myself look like a total ass and the chicks upped and left!

Or wait, no they waited off to the side all hot and bothered while you were being interrogated... suuuuure.
