Despite your own assurance of innocence, it is fairly easy for the police officer to get probable cause to cite you without a breathalizer test, with signs such as slurred speech, bloodshot eyes, alcohol on your breath, and so forth.

Ack, probable, not probably.

I also only travel while intoxicated only when necessary, and even then, bike is prefrable. Driving is illegal and walking gives a cop too much reason to stop you. Nobody expects a drunk biker 😀

Oh, to everybody who said to the OP was stupid that not admiting to drinking you have no idea what you are talking about. Sure, if the police officer wants to be nice he might let you off, but if he wants to be an ass you have just admited to whatever crime you did to an officer of the law which means that if something ever goes to court you are screwed.
 
Oh, as to the original poster. You demonstrated in your 1st post that you are a liar and that you were intoxicated at the time, so anything you say afterwards has precisely zero credibility.

BTW: The pen thing is used to determine Horizontal Gaze Nystagmus, and Lack of Smooth Pursuit. Both are readily researchable on Google.

My point is, he drank underage. He got a citation for drinking underage which is WHAT HE WAS DOING.... He deserved the citation. Maybe it wasnt the best way for the cop to give him one, but he still deserved it.

HGN is Horizontal Gaze Nystagnus. It is an indicator of alcohol in one's system by observing the eyes jittering horizontally as they look to the sides. More jitter = more alcohol. Vertical GN is used to observe the presence of other drugs in your system. Trained experts can tell you what kind/how much of a drug is in your system to a reasonably accurate estimate based on this test alone. You got owned.

Do you honestly think this excuse works? How many times do you think people try to say that? Heads up, genious. Alcohol on the breath and spilt alcohol smell different. The alcohol smell from drinking is caused by a release of carbon dioxide when your body begins breaking down the alcohol in your blood. I'm sure it was very noticeable when you were talking to him.

Secondly, you admitted to being in the club. He knew you were underage. Why would you have snuck into the club and not have had a drink? You should think of this stuff before you lie to a cop.

You don't need to prove BAC to cite for underage consumption. A BAC cannot be proven in your case, yes, but there were more than enough signs of alcohol consumption.
