Don't return it, the guy in Florida will report it and the store or the shipping company will eat the bill. Keep it man, keep it.!

Keep it!

<< However, think about the guy in florida who's trying to build his new server going... where the hell's my ram? it sohuld have been here 3 days ago!
>>

You know what they say, LIFES A b!TCH!

<< I was never charged for the second one but also like CKY said, what comes around goes around and I paid for it 1000 fold with my losses in the stock market. >>

I see no relation to your $500 monitor and a loss of 36% in the market value of every company.

<< It won't cost you more than a few dollars to write a note of explanation and send it back by U.S. Mail. It's worth it just to imagine the look on the guys face that opens it and realizes what happened. >>

Why should he put out any form of money to correct someone elses mistake?

If you think morals come into effect, think how a business would not hesitate in screwing you or giving you a hard time. They think MONEY, they don't think morals. And if they do think morals, your not dealing with a company.

keep the ram, the people here who say to return it are just puffing up their egos by thinking they're righteous.

<I see no relation to your $500 monitor and a loss of 36% in the market value of every company.>

Firstly, it was a $1,200 monitor which I only order one of but received 3 due to that company's poor inventory management systems.

But more to the point, I really believe in karma, ying/yang, or whatever you call it. It may have been total coincidence but I tend to think for every action there is an offsetting reaction and mine just happened to have come to my PA a few months later.

Thanks for the points guys. I see this stuff is pretty divided, which is pretty much how my feelings on it are. I would make a bigger effort to call them, but it is not even a 1-800 number and it is in Florida (coincidentally where the billed Thomas lives).

On a side note, I personally am not at all concerned with them charging the $142 on my credit card (can you believe ram is that cheap now?), that would certainly be illegal and I would have my credit card company contest it and not give it a second thought. I would also not think the guy in Florida is going to loose his money, he also would just have to contest the cc bill.

At any rate, I'll try calling them right now...

<< So if you piss me off and I think it's right to do some .50 caliber body piercing, that's OK with you? >>

Viper, I wouldn't give you the same advice. ;) j/k but yeah, some people shouldn't follow their moral compass. Determined on a case by case basis ;)

I'd certainly call them again to make arrangements to return it.

And regarding the often-claimed "unsolicited merchandise is mine to keep" statement which pops up all the time: That is NOT TRUE if a mistake has been made - as in this case. You ordered an item and got the wrong one which is not the same situation.

Legally you can keep anything that accidentally comes through the mail addressed to you. Morally i would send it back to the company.

kranky did you even read his post? He didn't order an item and get the wrong thing. He simply had used this company in the past and they kept him on file.

I think he had ordered before, I don't think he actually made an order this time.

Basically they have two customers with the same first/last name, & they billed one & shipped to the other.

If in your email or messages you offered to send the ram back then you no longer have a right to keep the ram and you need to send it back or they can charge you for the ram.

I Would Just call them & See what they want to do about it... Since it is already shipped they might even cut you a deal for it so they dont have to screw with the RMA since the ram cannot be resold as new...

You Might Also want to give the guy it was supposed to go to a call & Let him know what's going on...

The point is you're selling out your integrity for what at the time seems like a big lucky thing that happened to you, but in comparison to the other things that can happen, the free monitor was insignificant

that's a tough situation, but i would call the company, and even though it would be tough for me to pass on free stuff, i'd make an honest try to return the ram. But, i think i'd draw the line if the company tried to make me eat the shipping cause i already spent my time trying to return the stuff, and if they don't want to even pay the shipping, then they are dumb.

<< Hey buddy I'm Thomas Mitchell from Florida but I'm moving to NYC next week. So, I will pm you my new address and we can get this matter resolved. Just send the 1 gig ram chip there alright, thanks. >>

Who wants to bet this is just someone with a New York address and the patience to wait two weeks for a free gig of RAM?

LMK what happens, I might want to get some RAM.

I can see how you didn't get a hold of them calling them, but you emailed them and they haven't responded in a few days?

What's up with that? :p

If the vendor has half a brain, they'll figure it out themselves (tracking will show delivery and who signed for it). If they shipped it without tracking (USPS) they're SCREWED!

Don't let your conscience bother you though. LEGALLY you're not obligated to do squat. Sure, morally you might feel you are and the company might perk you for being cool.

I actually did this once. Had a guy send me a motherboard and a hard drive for exchange. The motherboard was good (don't know about the HDD since it was so badly packaged that it could've died in transit), so I sent the motherboard back to the guy... or so I thought. I shipped it to a guy with the same name, different guy. :Q The guy who got the board called and I issued a call tag. The guy who was SUPPOSED TO get the board got a call telling him what had happened and that a new board would be shipped UPS 2 DAY. The second guy insists on a new board shipped UPS Next Day with Saturday Delivery. I remind him that he returned a perfectly good motherboard assuming it was bad. He said he didn't care. I said "then you won't care if I don't send you anything and just charge you a 15% restocking fee for sending back good product."

Needless to say, he quit pushing his luck. ;)

<The point is you're selling out your integrity for what at the time seems like a big lucky thing that happened to you, but in comparison to the other things that can happen, the free monitor was insignificant >

I called them 3 times and told them I had 2 extra monitors that they accidentally shipped me. They told me they had no record of the extra 2 shipments and would get back to me. By the third call, they said we still don't have any record but why don't you send one back and we'll call you back to see what to do with the other one. They never bother to call or email me about it and the company did a huge $1 billion+ IPO at about the time so I didn't feel that guilty holding onto it.

I don't think I sold out my integrity. In fact, I think I went out of my way to alert them. I've had this kind of stuff happen alot of time to me, especially by Onsale/Egghead. They have accidentally shipped me 2 extra Callaway fairway woods ($200+ each) and RAM without charging me and I've returned them.
