If you have already made an effort to return it, and they haven't replyed, then keep it.

dkozloski, I almost agree with you, but this isnt a question of integrity, he
already showed he has a good moral compass in trying to contact the company to
get this straigtened out.

I also would not advise sending the RAM back before he has a chance to contact
the company. If their shipping department is so bad that they lost the other
guys order; there's no telling what could happen to a surprise return like that.

Keep trying to contact them to return the extra RAM, but put it in a safe place
until they contact you back to make return arrangements. You can of course
use the portion that you actually paid for.

I'm with dkozloski on this one, you should make a genuine effort to contact the store while it's open.

Legally, you probably have no problem keeping the ram, but morally, you're a thief if you don't make sure they know what happened

They already have your name/addy/email/cc number/shoe size etc. When (not IF, but WHEN!) they find their error, they're gonna bill you for it. Even thought it is their error, they will bill you for it. Why? Because they can and mostly because they have your info. The RAM was sent via UPS/FEDEX...ie. you had to sign for it, right? In legal terms, you knowingly committed fraud. Hey, I'm not playing "bad cop". I like free stuff and getting over as much as the next guy. I'm just not stupid.

Here's what I would do. Keep calling until you talk to someone. Arrange for them to pay 100% of the shipping costs. If they want it back badly enough, they'll gladly send you a prepaid FEDEX envelope. Therefore, you do the right thing. If they hem and haw, tell them "well, I tried..thanks for the free stuff" and hang up.

Call again, when they are open... if no response.. KEEP IT..

that would be the third time.. and if they don't have the time to respond to someone trying to help them out,, they aren't a very good company..

i say, give it one more try, and then keep them babies! :)

call em and tell em. Make a real effort to contact them. If they want to pay to get it back, send it. What goes around comes around.

No, he didn't. The package was in his name and addressed to him. He didn't know it wasn't meant for him until he opened it.

Like Pakman said, I also had two monitors (21" Sony FD Trinitron G500s!)accidentally sent to me when I only ordered one. I told the company (who shall remain nameless) that they sent me two extra monitors. They didn't believe me when I told them. I called them up 3 times to tell them and I finally got them to take one back. I gave up after that and kept the other one. I was never charged for the second one but also like CKY said, what comes around goes around and I paid for it 1000 fold with my losses in the stock market.

Our office ordered a gateway system. It came, but without the OS installed. Rather than waste our time with what they were supposed to do, we called and they sent a guy to install a new drive. The guy didn't seem to know much and couldn't install it, so we decided to asked them to send another one with a paid UPS return sticker. They did. Everything went well. Then they sent another system. Tempting to keep a gigahertz athlon machine, but we contacted them again for yet another return sticker so it's going back.

I say, try to return it. If they are fussy about getting back their own stuff, keep it.

according to federal law you are not obligated to send anything back to a company that sends you unsolicited stuff. that's the legal standpoint... you have the legal right to keep it at no expense to you.

morally, that's your call.

Send it back, even if it costs you. Your honesty is worth more than the $200 that a gig of ram is worth.

And Raspewtin:

IMO you definitely shouldn't keep it and return it. It sounds like you think it is wrong to keep it. you should follow your own moral compass, not just what's legal or not. Sometimes what you think is right will be technically illegal.

So if you piss me off and I think it's right to do some .50 caliber body piercing, that's OK with you?

ghostman, if it was Gateway I would have no moral objections to keeping the system :)

They are the lowest of the low over there. They probably owe me another computer just because their old POS they sold me last year caused me so much trouble and personal time.

<< If the mail wasn't addressed to you, but delivered to you accidentally I believe you broke the law even by opening the package. Postal rules say you aren't allowed to open mail that isn't addressed to you.

You can keep unsolicted merchandise sent to you if it was actually addressed to you (on the package). This is true even if the invoice says something else.
>>

yea right on, that's a good point too. but it ws most likely sent to HIM, since they share the same name

<< In this life you don't get many chances to demonstrate how your folks raised you. There are no mysteries here. You know where the RAM came from and you know it was not meant for you. It won't cost you more than a few dollars to write a note of explanation and send it back by U.S. Mail. It's worth it just to imagine the look on the guys face that opens it and realizes what happened. If you want to throw your integrity away save it for something worthwhile. Once you've lost it there is no way to get it back. >>

Very nice post.. You couldn't've said it any better

I'm sure if you kept it the store would go on without much of a loss. However, think about the guy in florida who's trying to build his new server going... where the hell's my ram? it sohuld have been here 3 days ago!

Add one more vote to make a genuine effort to return it. It's the right thing to do.
