1 Gig ram sent to me accidentally

Got a package the other day in the mail and inside was 1 gig of PC133 ram (4x256). I had bought from this store before so though the invoice said Thomas Mitchell in Florida the shipping label printed Thomas Mitchell in Texas (me). I called the store and they were closed and didn't have an answering machine. I sent them an e-mail a few days ago and have gotten no reply. My question is, should I just keep the ram? My father and friends say you have no responsibility to return any unsolicited mail, and I've actually already tried to contact them. Thoughts?

Well, I don't about your father being right with regards to him saying that you don't have to return unsolicited mail (I'm not saying he isn't right, I just don't know the rules) but I would keep it :D. LOL, 1GB of FREE RAM, it doesn't get much better than that :p.

Let's just hope you don't get a bill for it later.

You don't have responsibility for it legally speaking.
But personally I would return it for moral reasons.

But legally it's as good as yours AFAIK.

As long as they do not have your credit card number then I would keep it.

IMO you definitely shouldn't keep it and return it. It sounds like you think it is wrong to keep it. you should follow your own moral compass, not just what's legal or not. Sometimes what you think is right will be technically illegal.

Legally it's yours.

Morally if you have made a sincere effort to return it to no avail I would keep it. ;)

What about other Tom Mitchell in FL who's credit card most likely got charged and is wondering where his ram is? As far as what to do read my sig, I think it sums it up.

If the mail wasn't addressed to you, but delivered to you accidentally I believe you broke the law even by opening the package. Postal rules say you aren't allowed to open mail that isn't addressed to you.

You can keep unsolicted merchandise sent to you if it was actually addressed to you (on the package). This is true even if the invoice says something else.

rahvin: reread the original post-shipping label WAS addressed to him, invoice to the other guy.

1 Gig ram sent to me accidentally

And your concern is? ;)

I would try to return it because my guilt will haunt me. However, some other guy not getting his ram because it was shipped to you accidently is TOTALLY company's fault.. that is total BS

When the Tom who didnt get his RAM calls the company.. they will check thier records. Since your already in thier database, they will conclude they sent it to the wrong person. Don't be surprised to see something in your mail, or a phone call concerning this matter.

It's not yours, you didnt order it, or pay for it. If I were you, I'd do whatever is necessary to return it. Who knows, there may be something in it for you for your good deed, other than the knowledge of knowing you did the right thing.

I once had 2 monitors sent to my house instead of 1. If you tried to return it, and nobody ever replied... then keep it. No need to go out of your way to try to return it. In fact, they should come pick it up from you at your convenience.

In this life you don't get many chances to demonstrate how your folks raised you. There are no mysteries here. You know where the RAM came from and you know it was not meant for you. It won't cost you more than a few dollars to write a note of explanation and send it back by U.S. Mail. It's worth it just to imagine the look on the guys face that opens it and realizes what happened. If you want to throw your integrity away save it for something worthwhile. Once you've lost it there is no way to get it back.

Call the company when they are open and tell them about it. Thery might let you keep it if they dont think its worth the trouble of doing an RMA. Had somthing like this happen when i ordered an Intel 8-Port Switch from Onvia.com i got 2 more of them like a month later...called them up and they told me to keep them and think of them next time i needed parts.
