I would give him an ultimadium to pay you half the money in the next 3 months and then have him finish the rest plus compounded interest in the next 9 months. If he does not pay agree and or pay half in the next 3 months, I would file Criminal AND Civil charges against him.

the people that say "But he's family" need to realize that the BROTHER is the one who did the screwing, not urameatball.... Family or no... this is fraud, plain and simple..

I'd be more worried about the stuff he stole on New Year's. The money he got through fraud is in the past and while it's important to get it back, it's probably more important to make sure the company has the docs and info it needs to keep running.

What do you do? Obviously contact the law about this. If I was running a business and my brother took some cash I'd at the very least fire him. However if he took cash, and THEN went and did that, well you have to press charges.
if it were me and my brother, i could forgive him and let all the money stealing go.

but when he tells all the suppliers and customers the company is going out of business, well, that just crosses the line.

Here is a summary of all the good advice:

Hire a lawyer.

Hire an accountant to go through the books with a fine comb and find EVERYTHING.

Call the police and DA and report the embezzlement.

Call the IRS and report the theft and note that your brother skimmed the money and didn't pay taxes on it so is liable for tax evasion.

Change all locks, passwords and combinations on all building, accounts and computers.

Get your lawyer to issue a cease and desit order to your brother about contacting the businesses clients with false and misleading information.

Call all your business clients and report that the business is still viable and a terminated employee is spreading false rumors and that they should cease all contact with said terminated employee as he no longer represents your business.

And most importantly, sue your brother for the missing money.

IRS first, then lawyer.

IRS has a special task force when more than 100000 is involved, they have powers of arrest and will collect information VERY quickly.

Call District Attorney/Prosecutor's office, press charges on embezzlement, misappropriation, theft, etc.

sue - won't get anywhere because he'd rather burn the money and declare bankruptcy than give it back

call the authorities - he's behind bars... big whoop! money's lost, documents lost... I gain nothing

call IRS - no IRS in canada

call lawyer - done that and pending settlement... so far, he's willing to give back $18000 and leave the family alone. (slight gain, but damage is done)

beat him to death - personal gratification, does nothing to benefit the company though.


btw, we do garment manufacturing... clientel - tommy hilfiger, nautica, roots, etc.

I can't believe a brother would do something like this. If he is the kind to do so, he was a liability that you were aware of long before. I'd kick the living crap out of him, steal his passport and driver's license, and sell them to some black market bastards who'll ruin him with identity theft forever.

Well he has to weigh the possible extra gains against the time/money needed to get more money - which may or may not even be available.

I think we're settling with just that... money isn't the problem! just need the guy out of everyone's lives before more damage is done. So the faster a settlement is made (no matter how unfair it may seem), the better! I just hope he doesn't go beserk somewhere between now and the settlement on monday.
