YAJT - Question I have regarding a job situation

So heres the deal I have been at this same place for several years and have always done the weekend rotation due to my kid. We have weekday shifts the normal 8-5 coverage and then like a 12:30 to 9 or something close to those hours.

We just brought someone on to fill a vacant 12:30-9 about a month ago. This week another colleage announced they are leaving to go into private practice and their coverage was the 8-5. Now the person just hired is moving into the 8-5 slot without any kind of interview or the position being posted in any fashion.

Can they even do that without going through the interview process at least? Technically its the same position but different hours so I am not sure how that works.

Any insight would be great guys.

if it is the same type of position, why would you need to interview again? It's called being at the right place, right time.

Have you tried pulling the seniority card to try and get the 8-5 shift?

I didn't even know about it till I came in today that

A.) The person was leaving
B.) The shift was already given to new person

The decision was made during the week and I had no clue at all. It just doesn't seem right that I was not even considered or any of the others that cover the weekend rotation.

Of course they can. It's a lateral move, same position. He just asked for it first. Smart guy.

And even if it was a promotion/demotion, all the employer has to do is say "this is your new position."

Possibly the person who left had given enough notice that the employer knew in advance to hire someone new and used the other shift to train them.
Certainly nothing illegal about it (unless you have some kind of union contract/memorandum of understanding/written company policy that requires openings to be posted in-house before they hire someone from the outside to fill the slot.
I admit that it sucks for those who might have wanted the position however...

They might not have considered you if you told them the reason you had been doing the one shift because of your kid. If you had not informed them that you were available for other times then they probably just assumed you still were not available.
