If PAB was driving uninsured and the old fool hit him, then it is still PAB's fault. Not sure if thats been stated cuz most of the threads were just laughing at PAB's lack of driving skills.

Speaking of which, haha damn you suck at teh driving skills.

If any of you bothered to read the police report you'd see that under INSURANCE and VEHICLE 2 - STATE FARM is clearly listed. I have insurance, I just didn't have insurance for THAT CAR.

Plus - its clearly the old man's fault.

Yeah 50 feet from where the fvcking car was. See, had he been paying attention, he would have seen the old man merge over and slow down. If the old guy was stopped, then he must have been slowing down for a while, and its pretty easy to see a guy slowly merging into your lane up the road. He was probably bein a dumbass and wasnt paying attention. So from the point he looks up (THIS IS WHERE HE HAS 50 FEET) he cant stop. His goddamn fault for not paying attention. I doubt the old man locked up his wheels and swirved into oncoming with a smoke cloud pouring off his wheels. Generally old people do things slowly. So hes at fault for not paying attention to what the old man was doing. because he wasnt INSTANTLY stuck 50 feet infront of the old man while going 50 mph.

I'm driving down the road doing 50. I go through an intersection with a green light. See the intersection? It's right here. It's pretty damn close to the 7-11.

I pass THROUGH the intersection doing 50, the old man makes a left from behind 2 other cars in the left turn lane and STOPS his car, blocking both lanes of opposing traffic.

Now, there are about three or four people here who says "Its clearly PAB's fault because he could have slowed down to miss the old man" or "How is the old guy at fault? PAB didnt hit his car, so why should his insurance pay? This is clearly a scam."

Well, let me put this bug in your ear. If you're driving down the road at 50 and a someone drives right in front of you and you hit him - its clearly YOUR fault for not stopping in time, right? If someone is the CAUSE of the accident, even though they dont get hit - they still are the cause, and thus liable.

So anyways - when you're doing 50, you're going to need a lot of real estate to come to a complete stop. By the time you realize OH SNAP and the time your foot hits the brakes - that's a second. And according to some rudimentary personal injury law math, that's a lot of distance to cover. So instead of crashing into an old man with a heart condition who has failed to yield, I used some quick thinking and saved Geico about $20,000.

The distance to the intersection and the 2003 Malibu in my way is roughly 50 feet. It takes a second from OH SNAP till you hit he brakes. I'm sure someone here can figure out how much distance you can cover in one second doing 50. Anyone see red asphalt?

Insurance Co's always undercut the first check. They included reman parts and discounted labor / reuse materials, etc. Normally you could use it as a deposit to a reputable body shop and if the repairs go over they'd contact the insurer for additional funds. In this case, I guess it's in your best interest to just get the $5K+ check up front, but, after lawyer fees and such I don't see how you are going to come out ahead fighting the $3k one. Do tell if you do!

Not crapping, just curious how it works out with the lawyer.

If you're driving a '03 Dodge Neon, why does the police report show Car 2 as a '94 Plymouth? Did you or did you not have insurance for that vehicle during the accident?

nah insurance can cover a person driving any car... if you say let me borrow your car and i wrecked it ... my insurance would take over assuming i have i think its called stacked insurance...

I just went independant from my parents with car insurance... i had to deal with all there confusing wordings and ridiculous categories...
