I hate to have to post this, but what the hell.


- I sold an espresso machine on Ebay. Brand new/sealed.

- Buyer is claming part of the machine is not working(who knows the truth, and this espresso model seems to be prone to problems)

- Item is under warranty by manufacturer, my auction states no returns

- Buyer opens claim, rants in capital letters in poor english, and wins

Ebay buyer protection claims to be for items not received or not as described. It states "Please note that the eBay Buyer Protection Policy applies only to the transaction—it is not a product warranty of any kind."

I assume the buyer will be shipping this friggin thing back to me soon. Do I have any chance in hell at trying to reverse this decision? Surely logic will not help me...
 
Ebay's claims system is skewed toward buyers... I've even had a case where they admittedly did not review the case before deciding in the buyers favor and giving him money from my paypal account.

You might be able to call ebay and see what they say. Tell them you sold a new in box item and don't want a broken item. Maybe they'll credit you.
 
So frustrating. I'll give them a call after work, but I'm not too confident in any resolution. It just seems clear to me that nothing in the ebay buyer protection terms justify their decision.

Desi, I didn't insure. But I don't think anything was damaged during shipping, I wouldn't want to try and blame UPS
 
If under warranty - you can just ship it back to them. All you are out is the shipping costs.

Argh I always have the same worries about my ebay transactions now.

I usually sell my technology just out of convenience and since craigslist can be shady as hell, ebay is unfortunately my only "quick" option.

One time I sold a 32gb Zune. Didn't insure it and sent USPS (which I never do). Buyer received package but claimed the Zune was not in the package and only the charger. I knew this was gonna be a down hill transaction right after that email :/

I lost the money and the Zune. Sent the guy an email saying if he is telling the truth fine but i'm in the position where I'm completely suspicious I was scammed.

So lesson learned. I always now insure and require DIRECT signature. Its a pain in the ass for the buyer but it will hopefully save me in the future. I also take pictures of the item, packaging and keep the receipt for drop off. Even took a video for the recent iPad I sold.
 
I would love love love being able to get off ebay and paypal, but the alternatives are bare. I use craigslist occasionally but it's always a hassle and not the safest form of business. come on google, get in the auction game!

The headaches and hassles of ebay weren't worth it to me anymore. I'll donate to goodwill or throw it in the trash now.
 
unfortunately that's the pain of ebay. if you need to get rid of crap from your closet you got no choice but to use them. we made about $400 off of my fiance's coach bags that she never uses anymore. you'll just have to put up and deal with retarded complaints.
 
Just have to add on here -

A buyer from Alaska just emailed me complaining about the $3 shipping charge and the time it took to get there. Yeah, I made a huge profit off the $3 charge...
 
Did eBay/paypal company already withdraw funds from your account?

Maybe OP will have better luck finding the eBay's phone number than I did months ago while disputing pay-crap-pal overcharged fees. Emails were never answered, and I couldn't find for the life of me a damn Customer Support phone number to talk to a human.

I am with one of the posters here - if I can't sell it on Craigslist, it is going to the Good Will. Ebay has become too expensive for my taste. Fees are going up on both fronts: ebay postings and paypal transactions. How convenient.
 
You'll be lucky if the buyer even ships back the same thing you shipped to them. All they have to show to ebay is something was delivered to you (through a tracking number) basically.
 
of course they already took the funds 🙂 they took them as soon as the claim was opened. and last night I had to add money to my paypal account to cover it so that I could make a payment on something I bought...

I got no reply from Paypal service at all. They just refunded them without them having to return the item and closed the dispute.

Here it isn't bad, but some other forums I'm on it is getting real bad IMHO. I've slowed drastically myself and typically opt to sell to people I know before anyone else, even if I have to basically give things away.

I will still deal elsewhere but I typically request a USPS money order for payment. If they decline that, I decline the deal usually. Too many scammers out there and since paypal typically always sides with the buyer, it's not worth the risk to me.
 
Next time just donate the thing to Goodwill and get a receipt for tax purposes. Saves a lot of head ache. I would recommend craigslist... but instead of distant flakes you have to deal with local ones.
