So I get a call from our landlord, which surprised me because he is in the middle of a foreclosure and has lost receivership at this point. He just wanted to let me know that we had a few noise complaints and parking complaints.

First off, people have been gossiping about me and my roomate because we always have people over. A few ladies were talking to the neighbor that lives next to us and told her she thinks I pay for the house by letting people do drugs in the house, since there's so many "Ghetto" cars coming and going. Really? I'm younger and I have a social life, that's not a crime.

Ohhh but apparently it is, I was told that the type of cars parked in front of my house makes the neighborhood look bad. They are changing the bylaws so my guests can't park in the road or the driveway I'm renting. Fuck that, I'm 22 and I have 2011 Jeep. I'm soo sorry me and my friends aren't leasing german luxury. The cars in question are 2004 elantra, 2000 buick lesabre, 1999 camry, 1998 ford ranger, 2003 dodge neon, and my 2011 jeep patriot. Hardly every at the same time, they just frequent the house.

And the noise complaints are ridiculous, I get up early for work and three of my neighbors have teenage children you blast their music, have loud parties, etc late into the night. No one complains about them because their parents are respected in the neighborhood. But Me running an air compressor in my garage with the door closed at 8:22 pm gets me a noise violation. The kicker is it was someone walking their dog past my house that complained, my neighbors are cool with me.


So my question is, do I have to respond to any of this? I don't own the home, I did sign a lease stating I would abide by the HOA bylaws. However that lease no longer has consequence, the homeowner and bank both failed disclose commencement of foreclosure, which in my state give me the option of voiding my lease, which I did. The bank signed a statement to that effect. The landlord gave me the original lease, and the bank surrendered their copy to me.

What is preventing me from telling the HOA to blow me?

No? I guess you answered your own question. Stop paying the landlord if your lease is null and void. I hope you've already started looking for a new place.

The HOA can and will have unauthorized vehicles towed. That's the worst that will happen. Otherwise, they can force your landlord to start the eviction process. That's about it.
 
So...move? Maybe you can find a place where neighbors wont care if you're using a air compressor at night or if you have multiple guests park their cars in the streets.

To be honest, I'd be annoyed with the air compressor depending on how loud it is and how far noise travels in the area. I would also be annoyed if non-residents took up all the sparse parking spots in my area. As a resident, it sucks having to park 1/2 mile away when the neighbors are having guests at night and take up all the spots.

We fill the driveway and then park on the street, no one else in the neighborhood uses the street, but if they did we wouldn't be in their way. Our house is closest to the entrance, they are complaining because the type of cars, not that we have cars there.

As far as the air compressor goes, it's loud, but I know it doesn't bother the neighbor in earshot, we get along and I know she goes to bed at ten so I make sure I don't use it past then. No other house would be in earshot, as stated earlier it was someone walking by that complained.
 
You could always move. You're probably going to be kicked out soon anyway when the bank takes the property.

The bank has already taken receivership, there is a huge tax lein on the property, and now isn't a good time to sell. So i sat down with the banks property manager after noticing he was employed by the bank and not a third party. We came to an agreement where I will rent the house for 17 months, which we equal the exact amount of the tax lean. They are currently preparing a lease to this effect.
 
Start filing noise and other complaints about every single thing they do that could be a "violation" call in every single teenage party for being loud etc.

If so, I don't see how they can ban people from parking there, short of putting up "No Parking signs.

Supposed to be only two living their but usually it's 4 cars (one a commercial vehicle which is not allowed here) every night...they have destroyed his lawn by scalping it and then having 10-20 cars parking on it each weekend. They blast latin music until about 12-1am and do karoke outside.

Each monday the lawn and sidewalk is covered in broken Goya bottles (I don't get this part).

The awesome part is the guy that owns the place and I have been talking, they are getting evicted Dec 1st.

Most residential streets are illegal to park on. You can park on swales usually, but not in the road way. In most residential areas, the sidewalks are also illegal to block.

Started college when kids my age started Highschool. About average income parents, but supporting 5 kids, needless to say we were far from rich. And its a base model I bought with greensheet pricing.

So no lease right now, tell the HOA that you are not required to follow their rules. See if you can manipulate the lease with the bank to remove HOA stipulations, or to force reversion of the bylaws?
 
Sadly my neighbors also have a newish larado, recent chevy pickup, eclipse, and their tweaker friends a recent BMW and FJ cruiser.

Again, that sounds exactly nothing like us. What are you trying to say, we drive automobiles, and so do the people next to you? Everyone drives automobiles.

how does that sound like the OP? sounds more like my shit as neighbors, one bedroom duplex side with 5 grown adults living in it and 2 infants and a 12 year old. its 'legal' because they are related.

not where I live, most residential streets here have parking on atleast one, if not both sides of the street

No in most residential areas of the country (like those places those that matter in the world would live) you can't leave your car on a residential street nor block sidewalks. This is rarely enforced though.
