1) MS addressed the problem almost immediately.
2) MS offered to replace units that were even out of warranty for those that received an error related to the Fall Update. The 360 gave an error code E71 if you had problems from the fall update.

I've played my brothers, it's just a nice change of pace from the 360, but definitely not a replacement.. I mainly want it because it's more fun to play when friends are over than a 360 and my wife would play it with me. (don't like split screen much)

Blow me. I didn't commit fraud. You're just assuming I did. Two, it's not whining when you get raped out of $400. Third, this is about the lawsuit now... not what I did to correct my specific situation.

#2. you weren't raped of $400 - you would have gotten another system free of charge had you tried to contact MS. i know, I had a replacement sent to me last march.

My Xbox 360 died after less than 30 days of use. I took it back for full refund and I hate to say it but... *whipsers/coughs= "I'm getting a Wii"*

Much cheaper than X360 too I'll get to keep like $100

Probably get one in January... heard there were lots of shipments from the 1st of the year til March.

I don't know why people have sympathy for retailers anyway. 99% of the time they get a credit from the manufacturer with the advice to throw the defective unit in the trash compactor anyway. And who would want to protect the king of them all (Walmart) , which is where I'd bet most of the 360's have been sold. Its an evil company that only cares about money and profit margins in the first place.

I just bought one for my son and I on Monday. They had an ad on their website for a $50 gift card if you bought it in store. After buying it I had to argue with a manager to get the money. They said it ended on Sunday.......even though they are still offering the special on their website with no mention of an ending date.

I'm glad I found this thread, cause now I'm going to get the extended warranty for it.

lol, 99% just seems like a nice popular number. I'm sure its in the 90's though. I worked in retail for 5 years a good while back, and most the time it was the manufactures that took the hit.

We once had a brand new Bose system that the receiver didn't work on. All the speakers were fine. Bose gave the store credit and advised them to throw the system in the compactor. We sold the same speaker system for a grand or so without the receiver, but we still had to throw them away.

Thats about the most extreme example I can remember, but the point is that big retail corporations are in the position to shove around manufactures before having to foot the bill.

If Walmart went out of business tomorrow, it would most likely have a major effect on the global economy. That gives them a lot of clout.

To the OP: So how did you get a new Xbox then? You're getting all bent out of shape because people are reading you use the words "swap" and claiming you never contacted Microsoft so they assume (pretty reasonably, IMO) that you simply swapped your Xbox out with another one and stuck the retailer with the loss. Instead of getting pissed off about it, you could stop being so mysterious and just explain it to us.

And Microsoft just extended the warranty for all consoles to 1 year from now on, and that's 1 year from the 90 day warranty they already have, so launch consoles are fully covered as well up to 15 months.

People bitch and complain, and threaten to sue.......

Microsoft stepped up and is taking care of customers.......so quit bitching about it.

I have 2 360's, one broke. They fixed it and I moved on. People complain about Sony as well with their PS2 breaking and Sony not fixing them......
