Apple wanted to send me a 'fixed' one and didn't refund my money until I called AMEX. Apple is an evil corporation that sells sub-par electronics made from cheap laborors in China.
One time at Target I saw a guy return a Shuffle and they gave him a new one at the spot. They open it up there to make sure it works, and sure enough, it doesn't. So, they break open another one and it works.
Of course, with the first two, I just think they needed to charge it first. I didn't say anything though. I wouldn't care if Apple had to take back half a dozen shuffles from the same guy. The thing costs them like $30 to make anyway.
For the record, I would have just walked away unless it was a brand new one. It's solid state flash memory and no LCD screen, I'm not too surprised it worked.
