One other thing, if you do decide to talk to a lawyer, make certain they subpoena her cell phone records. Make sure she wasn't talking on the phone, or texting, while she was going through the intersection. Even if your state doesn't have a law against talking/texting while driving, if she was doing it, you can use it to show she was distracted, which will look bad for her.

Also, since you went to the hospital under emergency care, it shouldn't matter if it's out of your insurance company's network or not. HMO's will even let you obtain emergency care anywhere, so long as you transfer to an in-network hospital/clinic once the emergency is past, and you're considered in a stable medical condition.

I dont even know what the German method is, but if it involves special licenses for anything over 5000 pounds I support it. As do I support the notion people need to retake the drivers test every 10 years.

I am amazed at how many people run around at dusk and on cloudy days with no lights. Dont see if often at midnight though.
No kidding. Particularly cars that are gray, white, or black - depending on the environment, they can become just about impossible to see without lights.

Though around the city, sometimes it would nearly slip my mind if I'm starting off in a well-lit parking lot. Then the "It is currently nighttime" flag doesn't get properly set in my mind, until I see another car's headlights.
Now my standard practice is to at least turn on the parking lights; that way my hand is at least in contact with the headlight controls, which helps serve as a reminder.
 
Damn Im sorry for all the bullshit you are gonna have to go through. Try to avoid getting an attorney unless it becomes absolutely necessary. They are the scum of the earth and will try to f@ck you. The other drivers insurance company is going to try and deny all responsibility. Sorry to say man but you're in for a long drawn out nightmare. Hopefully you have an attorney friend or family member that could give you advice along the way. Hopefully it doesn't come to that. Good luck either way.

That site doesn't mention that it costs roughly €2,000 for it all and the "nine hour in 4 different situations" driving test. It sure instills in the Germans that driving isn't something you take lightly... and consequently, you have probably the best drivers in the world.

Yeah, that was just a brief summary; couldn't find a comprehensive overview of the whole process. I agree with you though, we need to make the tests A LOT harder.
 
Do you remember if the lights on your side were working? Depending on how big of an intersection it was, the lady probably didn't slow down much before crossing, especially if the lights were down.

yea ive thought for a while that we need to adopt their method. Also if you lose your license there you have to fork over that 2K again _ take the course again, unlike in this country where you simply say you are sorry and they give it back to you
 
my main injuries included lung contusions (bruised lungs) and worst of all a fracture to my acetabulum. Having just finished an EMT course I knew the acetabulum fracture could be REALLY BAD NEWS

I feel your pain OP. I really do.

14 Nov 2000 I'm driving drunk on a main thoroughfare (I-95 in FL from Miami up to Fort Lauderdale) home from my friends house. I was young (I had actually just turned 21), stupid and cocky with a 0.23 BAL thanks to the 151 and overproof + bloody mary's I had been scarfing down all night.

I stopped being aware of my surroundings just beyond the FLL airport, the next thing I knew it was Dec 1st and I was hooked up to a loooot of stuff, including a morphine drip and 40 lbs of traction. Bystanders report only that they came upon my vehicle which was upsidedown with the driverside door wedged against the highway barrier. I'd apparently stopped steering at probably 70mph and impacted the barrier at speed. No others were involved. Thank FSM for that.

My most serious injury was the acetabulum fracture, because of that I had an inferior vena cava (greenfield) filter permanently implanted. Its to catch and break up and major clots before they reach the heart (cause of heart attack), lungs (another type of heart attack) or brain (stroke). Anytime a major bone in the body fractures they worry about that stuff, as the bodies response to a pelvic fracture or femur or ribs, or anything like that is to clot and swell.

I also had fractured a bone in my right foot, broken (compound) my left elbow, and removed most of my left thumb. I had surgery to implant stabilizers in my elbow, and another to replace most of the bone in my left thumb with bone harvested from my right foot.

For the hip fracture (more of a pelvis injury as you've noted) they drilled through my shin with a damn 1/2" piece (seemed like it, was probably really only about 1/4" )of threaded rod and hung 40 lbs of weight. The idea was to keep the hip (top of pelvis) away from the acetabulum, thus removing any need for surgery. Well I would have much rather had the surgery as 2 months on my back in the hospital was nearly my undoing.

Long term effects include awesome scars, mental health problems, my thumb gets sore, and I've been completely banned from any sort of impact activities including running, jogging, team sports, tennis, etc. Even a short run gives me some pain deep in the hip and I know better and have to stop.

That you are walking around on it and not laid up in the hospital is a miracle, and I hope you sue the everloving fuck out of the nit that wasn't paying attention whilst driving.
