Oh yeah, sue the hell out of her anyways. It's the American thing to do, right? Pain and suffering, time off work, etc, etc......man, I bet that's worth 6 figures, minimum! :whiste:
One other thing, if you do decide to talk to a lawyer, make certain they subpoena her cell phone records. Make sure she wasn't talking on the phone, or texting, while she was going through the intersection. Even if your state doesn't have a law against talking/texting while driving, if she was doing it, you can use it to show she was distracted, which will look bad for her.
Also, since you went to the hospital under emergency care, it shouldn't matter if it's out of your insurance company's network or not. HMO's will even let you obtain emergency care anywhere, so long as you transfer to an in-network hospital/clinic once the emergency is past, and you're considered in a stable medical condition.
