you are correct about #3, you cant sell anything about the game for real money period.

i think i might post this in the WoW forums, just to see what happens to him.

All title, ownership rights and intellectual property rights in and to the Game and all copies thereof (including, but not limited to, any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural or landscape designs, animations, sounds, musical compositions, audio-visual effects, storylines, character likenesses, methods of operation, moral rights, any related documentation, and ?applets? incorporated into the Game) are owned or expressly licensed by Licensor. The Game is protected by the copyright laws of the United States, international copyright treaties and conventions, and other laws.

Blizzard owns all in game content. Why are you selling something that does not belong to you?
 
not only that, there is NO way to safely transfer a character or account between real people that the original owner can't take it back with a simple phone call to Blizzard customer support.
 
sorry i can remove the link if you want, but did you read the auction? I'm selling the game, the account is FREE. How is that against blizzard?

its the same way ppl were selling WoW gold(money) on ebay, they said they were seeling the time spent getting the gold. yeah, that didnt fly either, what makes you think you can do the same by trying to find a loop hole. and if you are just selling the disks, why are you seeling them for $149?😕

You could argue that he has a license to access that game content and he is selling that license to somebody else. To counter this, you'd have to demonstrate that selling his license is illegal.

Note: this seems to fall under section 3B (although nothing seems to be specifically stated about the actual accounts).

You may permanently transfer ownership of the Game and all parts thereof, and all of your rights and obligations under the License Agreement, to another by physically transferring the CD-ROM, all original packaging, and all Manuals or other documentation associated with the Game, and by removing from all of your home or personal computers and destroying any remaining materials concerning the Game in your possession or control, provided the recipient agrees to the terms of this License Agreement. The transferor (i.e., you), and not the Licensor, agrees to be solely responsible for any taxes, fees, charges, duties, withholdings, assessments, and the like, together with any interest, penalties, and additions imposed in connection with such transfer.
 
its sold now but thanks for the input. It could be a little iffy on the rules but so many other people are doing it. And I didnt list my account name on the auction so how'd anybody know?

If Blizzard really want to know, they could figure it out. If you listed race, server, class, and level, that narrows it down a bunch. If you listed any items you have or gold amounts, even more.
