The money you pay and his delivery of the computer is consideration. Thus, all elements of a valid and enforceable contract for the sale of goods are met.
Over $500, a formal agreement is needed. This would qualify as formal, right?

(I've only been in basic law classes, not sure if it is even needed, but it said something to that effect in the book we used)

yep. from the sound of it you didn't really want it, and now he doesn't want to sell it. sounds like perfect to me

He ISN'T going to sell it to you for that much since he thinks he is losing ~$500, what he doesn't know is that the most it is possible worth is $650 and since you don't need it you really shouldn't buy it for $530. You could probably make $30-50 on the fs/ft forum after having to pay shipping but like I said I don't think that he's going to sell it.

I think it is a good suggestion to ask him to pay you $50ish and good feedback then you will let it go, he might do that.

Just let him back out, you're taking a risk of receiving a damaged computer if you try to push it. Leave him a negative feedback.

Don't pay him and don't expect a computer. If he did send it, he'd probably mess it up or remove some of the better components.

I don't even think there's a reason to leave negative feedback. You didn't even make a deal. You didn't trade anything. He was honest and up front. Don't try to squeeze money out of him, that's just greedy. Let it go.

Whatever, maybe I'm too nice, but screwing someone over for something like this is just stupid.

whats the deal with everyone saying the seller should send the op money?
if someone asked me that i'd laugh in their face. besides, isn't extortion illegal?

At this point, I understand that the goal is for both parties to cancel the deal and receive positive feedback. Demanding money from the seller would be counter productive and might very well result in both parties getting negative feedback.
Demanding money in this situation is Not a good idea considering that the buyer is more then happy about the deal cancelation.

Never buy a computer off ebay no matter who the seller is. Sellers don't care about their customers.

Not true, my bro bought an alienware laptop for a really good price. Then he managed to mess it up by adding memory or a changing the hdd or something like that. The seller honored the 6 mo warranty, paid for shipping, repaired and returned in 2 weeks.

All right everybody thanks for the advice, I've decided to cancel the transaction but for a price....he has to sell me the video card for $120. What do you guys think?

Here is the message I am going to send him, tell me what you think of it before I send it.

Umarsohrab,

I won the auction and according to E-bay rules and regulations you are obligated to sell the computer to me for the final price of the auction. I find it hard to believe that you didn't know what you were doing when you listed this computer on ebay, it sounds to me like you didn't get the price you wanted and now you are trying to cop out by saying you didn't know how to set a minimum.

I am a reasonable person though, so I will cancel the transaction for the computer if you sell me the video card in the computer for $100. I think this is a very reasonable offer considering the X1950XT sells on newegg.com (http://tinyurl.com/2v6j28) for $150 after rebates. I am offering you $100 for a used video card that sells for $150 brand new. If you would prefer not to sell the video card to me, I would then like to continue the transaction for the entire computer as you are obligated to do so if you wish to follow E-bay rules and regulations.

Please message me back and tell me what your thoughts are. If you agree to sell the video card to me, we can cancel the transaction on the computer and you will then need to list the video card separately on E-bay with a "best offer" option. I will then be able to make an offer on it and you will be able to accept only my offer.

If he doesn't agree to sell the video card, I will just cancel the transaction and not bother with anything else, but I want to make him think that if he doesn't sell me the video card for $100 then I will buy the entire computer for $530 (The final price of the auction + shipping).

Don't forget to threaten with a neg if he doesn't follow through. Say something like "I would prefer to get this resolved before leaving appropriate feedback" Then say "I have a friend named Tony who would be more than happy to make your aquantaince should certain terms not be met."

lol, you think I'm a "f-ing moron" for trying to get at least something out of this deal? I'm giving this guy a chance to sell me his video card for a relatively good price, in exchange he keeps the rest of his computer.

What do you suggest then? Just cancel the whole thing altogether and tell him to leave me positive feedback then leave him negative feedback?

why not?

you already said you didn't need the pc. you're an idiot for continuing to buy something you don't need. you're also an idiot for wanting to buy a used video card for almost retail price. if i was in your position, i would have agree with the dude instead of wasting all this time trying to figure out a way to scam the dude.

See the thing is I don't believe you. You could just say that because I have no idea, you may be a major ebay seller just trying to make yourself look good.

Well the video card he is selling is a X1950XTX 512Mb and the price I quoted from Newegg is a X1950XT 256MB for $150 after a $30 mail in rebate. His card probably sells new for $250+, not sure since Newegg doesn't carry the X1950XT anymore.

He didn't sound like he knew much about computers so let's hope he makes the same mistake you did and thinks I'm offering him $120 for a used video card thats sells for $150 new. Maybe I'll change my offer to $100 now that I think about it.

so this has nothing to do with principle, its all to do with scamming the guy out of his stuff. i've seen all i need to see.

Scamming him? He is the one that wants to cancel the transaction breaking E-bays rules and regulations. I am being generous (And a dick) by letting him get out of his obligated transaction by just selling me the video card instead of the entire computer.

see, the thing is I don't care if you don't believe me. I've never sold a computer on ebay, nor do I plan to. And even if I did, advertising on a ATOT ebay thread probably isnt the most effective way to go, wouldnt you agree?

My bro chose to buy one off ebay, did his research on the seller, contacted him before purchase, and all went smoothly.
