Wow that's even more stupid then. The wording sounded more like the dog that died went in the pit bull's yard.

If I had to guess, I would say that her story will be that the fence was the neighbors responsibility and that he failed to maintain it properly.

Crazy lawsuit that should get tossed. However, if the fence was his responsibility I feel no sympathy for that guy.

Utter bullshit.

In most areas a fence does not have to be built at all and if there are local statues or HOA regulations regarding mandatory barriers between properties it's a shared responsibility. If the fence belonged to the guy with the beagle and was his and his alone his only legal obligation is to prevent his dog from getting out. It's 100% the responsibility of the owner of the pit bulls to assure that her dogs can't get off her property and cause damage somewhere else. Whether the beagle owner had a 15 foot tall castle wall with a moat guarding his yard or no fence at all it's not his responsibility to make sure his yard can't be accessed by her killer dogs.

Must have been a very aggressive beagle, everyone knows pit bulls are sweet loving family dogs that are just misunderstood.

pit bulls are a litigation hazard. If you own a pit bull (land shark) you are a lawyers wet dream.

You cannot bring forth a ridiculous suit like this without a lawyer. If a suit is labeled as ridiculous, the lawyer has to pay a penalty of 30% of the amount sued for if the lawsuit is thrown out.

As it is now, lawyers have nothing to lose from bringing forth these ridiculous lawsuits - they can only gain (well, they can lose a bit of their time, but with the surplus of lawyers in this country, in general, it would seem that they've got the time.)

But the reality is that they don't set out to specifically hire mailmen that aren't afraid of dogs and furthermore all media focus tends to single out Pit Bulls as the only vicious dog as if they are all vicious and mean which leads to what's basically racism against pits. There are many people that are legitimately afraid of Pits alone...I have one and when I take him for a walk, I've seen the fear on bike riders faces as they ride by. Funny thing is he's the biggest baby and is great around cats and kids...but you can't convince anyone that they can be as friendly as any other nor that other dogs can be just as vicious.

So he took advantage of both, the fear of pits from media focus on bad Pit owner's dogs and his reaction which led to his injury which would not have happened had it not been for his fear of Pits. Plus the fact it was a Pit is actually what it all came down to and won him the case as stated by her lawyer. The judge told her she should have had dog liability insurance and she did not tell her homeowners insurance as required for having a Pit apparently...which they may have dropped her if she did. The judge felt based on pictures, testimony that her fence was too close to the mailbox...it's about 2 feet I think.

I don't side with either, It's partly her fault for having a known feared animal roam behind a standard chain link fence...I would have kept him hooked to chain at least or kept inside. Her lack of forethought got exploited, that's all there is to it.

I hear 'ya, we have a Pitt as well, she's a smaller one @62lbs but nonetheless people are terrified and steer clear when I walk her. Homeowners insurance stopped covering dog attacks years ago, no matter the breed. Dude probably knew his doctor very well and told him to play nice for a "piece of the action", what a fucking wimp when just hurrying back to your vehicle causes injury. Your right on one thing though, mine is never out of my sight and always on a leash.

BINGO! Any lawyer with a bit of down time can just throw something against the wall, and see if it sticks. Often, (depending on the target), there will be a payout/payday just to make it go away. You, and I are usually the losers here,(insurance). I kind of like the way they do it in the UK. File any frivolous lawsuit you like, BUT, the loser must reimburse the defendant for all costs incurred to defend themselves.

pit bulls have a homicidal maniac gene. no amount of "awww, he's such a good dog! he would never..." will change that. the only good one is a dead one.

they seem to be pretty popular among the lower class in rhode island. coincidentally, i didn't know until recently that dog fighting was taking place within city lines this far north.

I agree pit bulls do have a more aggressive streak compared to other breeds, however, I don't agree they with the sentiment that they are bad, however, weaker and less attentive owners will likely find them to be too much to handle. This applies not just to Pit Bulls, but any strong breed in general. If you're the owner that puts your foot down on any sign of defiance, a Pit Bull is as good a dog as any. At least, this has been the experience with my Pit Bull, now 13, and quite frankly, that aggressive streak has actually served well in the past as she spotted and attacked a rattlesnake in some brush before my dad walked in there.

Sucks to have your homeowner's insurance. Ours covers our dogs. Then again, Goldens and Labs don't have quite the reputation that pits do.

It varies wildly from state to state and as you said breed, some Ins. Co's will pay on the first incident but not thereafter, some require a separate policy for dogs. In FL I have to have a separate policy just for "wind" damage LOL, Once insurance Co's start having to pay claims they come up with all these restrictions or needing a separate policy.

My daughter was in my front yard with our dog, Bennie (Chow/Golden Retriever) when the neighbor let his dog out the front door to go for a stroll. Mind you... He wasn't going with the dog. His dog was a little thing... Maybe a poodle or something. Anyway... His dog came straight over to my yard and started sniffing my dogs butt. The neighbor looked out the window... Became alarmed, ran out the house and over to my yard. My dog turned around and started sniff his dog. He scooped up his dog, punched my dog, turn to run away and Bennie bit a chunk out of his right calf! He swore and cursed and threatens to sue me. He called the cops. The cops cited him for letting his dog out unsupervised and trespassing on my property. I told him if it ever makes it to court I'll have his house when I'm done. He never took it any further

This! The guy chose to do nothing, she escalated it into a ridiculous lawsuit, an attorney stupid enough to take the case. COUNTER SUE THE B****!

They're great dogs. Other than a tendency to chew things they are very mild mannered and friendly dogs.

Speaking of chewing on things, I managed to break mine pretty easily of chewing on anything but his toys. The only chew toy that lasts longer than a few minutes with mine has been Nylabone brand. I even tried a toy that was like a spare tire with some kind of tough rope that said how it was the toughest...etc but didn't last no time. Bastard's got some jaws I'll give him that. Some of the larger Nylabone's usually last pretty decently but he gets bored with them once the ends are gone and has to have a new one.
Dog toys and treats seem kinda pricey to me but whatever keeps him happy and away from my work boots.

Oh a pitbull mauled someone/something, real shocker there.

My umbrella policy has a specific exclusion for pitbulls, other dogs are covered.

DP, halik, and they mauled the owner while they were killing another dog.....good mauling, imo.

In Lake Worth, Florida this week, a 5 year old was attacked by a Black Lab mix. Her Pit Bull ended that rampage and almost killed the other dog after that Lab bit her face.

The Lab was euthanized. Despite cries to have the Pit Bull also killed, it was not.
