Why do the idiots on "COPS" always say yes when the cops ask to search thier cars?

They always have drugs or guns.Why don't they just say "no" and tell him to get a warrant?

Warrant would arrive in all of 10 minutes, and they may receive leniency for cooperating. They will get you either way

Yeah right, like they're going to wake up a judge in the middle of night to say "Hey, we pulled over some guy speeding, and we think he might have a joint in the car, will you issue us a warrant?"

Theres typically a reason they search cars, and most would not hesitate to call for a warrant. An ex GF of mines Dad is now a Lt in the SC state patrol, and had a few stories to tell about "routine traffic stops" that went haywire...if they were not granted permission to search the car, they called for a warrant, if that was unavailable they impounded the car. Like I said, they will get you no matter what.

So, you think because someone says "No occifer, you cain't search mah car"...they are gonna let them drive away. Thats even better than the weiner crack.

I don't know if that's supposed to be a drunk accent or a redneck accent, but if it's a drunk accent I'd expect them to give him a sobriety test, and if he fails, arrest him on drunk driving. If it's a redneck accent, yes I'd expect them to cite him for whatever they originally pulled him over for and be done with it.

Sometimes a cop asks to search because they are d8cks or corrupt or whatever, sometimes they ask for legit reasons. In the former situation, they usually just let you go, in the latter, they will call for the warrant.

In all seriousness...its my understanding these laws differ state to state. The impression I always got (again from conversations with Police etc), is that they can impound your car for the smallest infraction if they see fit. So in the end, if they are suspicious of what may be in there, and are denied the right to search, they can impound your car and wait on a warrant.

Then there is the hazy area of "probable cause" which allows them to search w/o a warrant. Again...if they want in, they are getting in

Ifd they can impound your car (which, like you said, most liekly varies with locality) I'm sure they will do that ad wait for a warrant if they think you've got a dead body in the trunk. However, I doubt many cops are likely to spend that much effort for someone they suspect might have $10 worth of marajuana in the car, which is often what the people on those shows have.

They will wake a judge up. Also a lot of the time they can find probable cause somehow. If they have suspicion they will get a warrant or figure out a way to apply probable cause.

Edit- One other thing... if anything suspicious is seen in plain view they can investigate it and if it is illegal they can then have probable cause for a full vehicle search.

in regard to "Cops" yes...a roach will not lead to someones car getting impounded...

The question I often ask when watching that show is "Why the hell did they run, when they were getting pulled over for running a Stop Sign"

They could always take the "World's Dumbest Criminals" option, and throw the drugs/guns out of the car at high speed. Ofcourse, while the police car is chasing and filming the whole incident. Makes for a really quick trial.

I always liked the one where the cop asked the guy repeatedly if he had been drinking or smoking anything. The guy kept saying no, he hadn't.
The cop says "well then, what's this behind your ear".
The guy had a joint stuck over his ear. OOPS!!! :D

Please enlighten me to where I said or implied that there is a cause and effect relationship between a cop wanting to search your car, and him being a d8ck or corrupt.

I stated that *SOMETIMES*, cops can be d8cks (like any one else, in any other profession - cops are not angels), and can be corrupt. I have heard more than one story about a cop asking to search someone, they say "no", and the cop just moved on.

Cops don't need a warrant to search an automobile, all they need is probable cause. (United States v. Ross)

When the search is done incident to arrest, the police don't even need probable cause, they can search any area of the car which is under the immediate control of the suspect (i.e., usually only the passenger compartment, not the trunk).

The idiots on COPS can say "no" all they want, doesn't make any difference.

I said NO, and had to wait 2 hours and they did get a warrant. It was 2am when I got pulled over so I quess they did wake up a judge.

BTW this was in NM between El Paso and Las Cruces. They found nothing! This was back in the day when my hair was down below my belt and I drove a Trans Am, I was doing 90mhp the cop said I fit the profile of a drug runner.
