A decent attorney can make a case out of pretty much anything...

Fair enough . . . but not every decent attorney can win an iffy case!

You only need to make it look good enough to reach a nice settlement. ;)

I have been on FMLA leave since September. My doc and I finally decided that it was time for me to go back. I have to be back to work at 10am tomorrow. My boss is a super control freak guy, so I know it made him mad that I took the time off. Plus I bypassed him and dealt with HR directly.

So...who thinks I am going to get canned tomorrow? Michigan is an at will employment state, so they can fire me without reason if they choose to.

Not 100% true. They have to let you back into the building and give the appearance of you resuming a comparable position to what you had. Once that's done, THEN they can fire you.

If they s-can you before then, you'd have a case that they were retaliating against you for taking FMLA leave and you could sue their pants off.

Really now? I did not know that.

My one saving grace may be that we are getting bought out. I wouldn't think the boss guy would care too much knowing that we are all probably getting let go in June.

Talk to a lawyer. It's worth a shot

Before you hit me with "it's only a negligible amount", think for a moment about how many people are covered, then start looking for that car fire.

Careful, nips. I hear AT is an "at will" membership site.

A. I am happy that you are taking your canning like a man. FMLA is BS. If you are too sick to work, your poor employer should not be forced to have to keep paying your worthless ass. I know by stupid law, they are, I'm just saying I don't agree with the stupid law.

B. I am not so happy to hear you are planning on becoming a state-funded sponge. You are too old for primary vocational training if you are over 25. Get a fucking job!

A. The FMLA allows 12 workweeks of UNPAID leave.

Still covered by employeee benefits, still paid, still have to be managed, still paid, still cost them $$ in any way, still paid. Not all pay is cash. Not all pay goes to the employee (another problem).

Leave work against the wishes of your employer and they should be able to terminate pay and all benefits you on the spot.

Be more valuable to your company.

What do you do for a living? How valuable do you think you are to your company? Just curious.

I can't speak for the guy who asked, but what I do is hope beyond all hope that I never turn into a self-righteous douchebag like yourself who thinks he knows all the ways of the world far better than everyone else inhabiting it.

I hope your six-figure disposable income isn't all used up trying to buy friends and happiness. Actually, that's not true, I hope it is since it's the closest you'll come to finding the real thing.

Thanks! But I am perfectly ok with it. I think the boss guy was kind of shocked at how calm I was during the whole thing.

I live one day at a time now. Today was a pretty good day...we'll see what tomorrow has in store.

isn't that like, lawsuit time?

No, he exceeded his 12 week allotment of FMLA job protection. All his boss has to say is that he was terminated for excessive absenteeism outside of the FMLA protection.

Note: This is under the assumption that they did not grant him this time off under a personal leave, and, as he has yet to explain to me how he got >12 weeks of time off, it is the assumption I will operate under.

Edit: Granted, his company will still have to pay out the ass even to settle a lawsuit, so if he wants to be a dick, he should go ahead and file.

I assume this is the issue that kept the Division Manager on the cell phone for so long before the boot was issued.

Alcohol and Xanax.

The Xanax was prescribed to me legally and the alcohol...well I work in sales. If they could fire people for being alcoholic, there would be no sales force left.

Having worked many years in sales, I proclaim the bolded to be both true and sigworthy.
