Not 100% true. They have to let you back into the building and give the appearance of you resuming a comparable position to what you had. Once that's done, THEN they can fire you.
If they s-can you before then, you'd have a case that they were retaliating against you for taking FMLA leave and you could sue their pants off.
Really now? I did not know that.
My one saving grace may be that we are getting bought out. I wouldn't think the boss guy would care too much knowing that we are all probably getting let go in June.

Leave work against the wishes of your employer and they should be able to terminate pay and all benefits you on the spot.
Be more valuable to your company.

No, he exceeded his 12 week allotment of FMLA job protection. All his boss has to say is that he was terminated for excessive absenteeism outside of the FMLA protection.
Note: This is under the assumption that they did not grant him this time off under a personal leave, and, as he has yet to explain to me how he got >12 weeks of time off, it is the assumption I will operate under.
Edit: Granted, his company will still have to pay out the ass even to settle a lawsuit, so if he wants to be a dick, he should go ahead and file.
