When is eminent domain acceptable to you?

Personally I think it is acceptable as long as the government thinks it will benifit most of the citizens.

Example:

Your business/home located where the city thinks a grocery store would benifit the most people, they should be able to use ED and take your land from you.

To seize controle of assets of large companies who are providing services such as electricity.

What about places that provide services for the public, such as the cable company, electric company, water company, ect?

The use of ED for things beyond land, like cables, powerlines, and equipment.

Then you open up a slippery slope about a host of private purposes that could serve the public interest.

I'm sure my friends and I would like an In & Out Burger next door, but I doubt my neighbor feels the same way.

I would say its better to be too cautious concerning eminent domain than too liberal with its usage. You really don't want to start a precent where emnent domain is used on a regular basis becasue remember that it isn't going to be YOU who decides what is most in the interest of the "public", it will be government officials and they likely won't believe the same as you concerning alot of issues. Also, there is obviously a HUGE avenue for abuse of power there where the government helps out their buddies in teh private sector by gettign them the prime realestate below cost "for the public good".

WHAT? Eminent Domain should be used for public uses only. The government shouldn't be able to take your business so a grocery store can move in, that's ridiculous. Ever heard of property rights?

That's what I can't remember. I remember he went on a religious flame-fest and disappeared but I can't remember if he was banned. Of course, if he wasn't banned, why come back as UCDAggies?

Mods could clear this up pretty quick. Was DVK916 banned or did he just go away?

Infrastructure and necessary services only (i.e. major hospitals, first-responders). Opening up Eminent Domain for use by the private sector is not riding the slippery slope, its on the rocks at the base of the cliff. The government exists to serve the people, not the interests of business to the point of bending its citizens over and sticking it in raw.

I would say almost never unless it is really really really needed by the public in order for it to survive, otherwise the city or whomever needs to find another solution or buy out the owner at a price they don't want to refuse.

I find the idea criminal otherwise. Sorry but I don't feel like infrastructure improvement is a precise enough reason to give someone as a reason they have to quit their property and home and take or leave it on the price we decide you deserve. I say big middle finger to that.

NEVER. The entire concept of the government forcibly taking anything from anyone is beyond me. I understand the point of easements, and those are specifically written into contracts. But ED is a crock of steaming communist sh1t.

Unfortunately people like the OP and at least 5 members of the current US Supreme Court seem to feel that stretching the meaning of this to cover tax revenue derived from redevelopment is a "public use".
