Spanky, I would call this guy back and tell him you have consulted a lawyer and are considering taking this up with small claims court, even give him a few details such as the $3k limit in NJ for small claims, so he'll know you're not BS'ing. What do you have to lose here? A good car at a good price. You won it fair and square, if you want the car, I seriously think you can get it.

If not, leave neg feedback. If he does the same, then sue him for slander.

this is just a sh!tty situation. as others have pointed out, if he is forced to give up the car, i am sure he will sabotage it in some way. i'm going to see if he calls back and offer to make things right in two weeks. if nothing, i will proceed with neg feedback.

or better yet, i should email him and tell him to leave me some pos feedback... then give him neg feedback. oh that would suck!

If the car doesn't come working as described in the auction - you can do ebay fraud too. If he does sabotage there are plenty of things u can do.

The dude came down yesterday (Thursday) checked it out and paid me in cash. I saved on paypal fees but didn't make anything on the P&P.

It was a 6"3 french man about 240lbs that came. I'd have kicked the crap out of him he tried to pull a fast one on me!

So in the end it worked out fine. He was 20minutes late which p!ssed me off...
