I purchased a comdial small office lite voicemail system, and it had the license key on the back in the pictures.
Without the license, it is just another P66 with 8 mb of ram, a voicecard, and a 2 gig drive. Worse than a doorstop.
It gets here without the key. The seller is adamant that he sent everything. I am now at the mercy of paypal buyer protection:(

I sell this item on ebay and I don't mention anything about collection (in London, good 60min round trip + parking fees etc) on it because it is a hassle to do at the moment. This guy wins with 130 feedback or so, 98% positives. He is now asking me to meet up which costs me money and time. This WAS NOT PART OF THE LISTING. I don't perticularly want too as I'm busy.

The item sold for £707 + £20 (P&P) + £10 (insurance required).

I think he just wants to stiff me out of paying for the delivery charges.

I also mention in the item listing that people must pay me by 72hrs after the auction has ended via paypal. This guy is p!ssing me off!

if you stated a shipping cost, and had no mention of the option for pick up or delivery, then why should u do anything but ship? thats just my opinion...

there's nothing wrong with 4th gen accords if you find one that has not been abused. CL has nothing for me, as i did give it a quickie search.

Who knows what kind of abuse the seller could do to the car if you force him to sell it. Give him a neg and move on. Its not like there isnt 14543455432 more Accords out there.

you dont want that car dude.... if someone forced you to sell your car and (in your mind) you didnt see a reason why you should be forced, wouldnt you sooner destroy it before handing it over?

The guys coming over my place around 6pm Tuesday now.

This means I don't make any £££ on delivery but I save on paypal fees. HE SO better have cash as no way am I going to take a cheque off this guy...not sure how much it would have cost to send something with £720 insurance on it in the UK anyway that weighs a couple of kg's.

i never forced him to put it up on ebay. if his story is not BS, well i am sorry for his misfortune. but sucks that his misfortune is now mine? wtf?

I find it ironic no one is bashing you for wanting to sue when ATOT usually go crazy when a news story about a lawsuit is posted.

Don't really have much experience with deadbeat sellers. I know that I used to get a few deadbeat buyers a month until I put some very clear legal threats (all empty, but convincing enough) in my auctions.

Sounds like the seller had remorse for selling too low. Try to get him to sell the car, but you're going to have a hard time actually forcing him to sell it in court. You will however be able to recover money if you can show he backed out of a legal contract to sell.

I disagree. The guy is obviously not selling because it didn't go for as much as he wanted. Spanky has every fvcking right to sue this guy. I myself have shipped out one or two computers that I lost a few bucks on, including a Dell 8400 with an X800 XT card that went for <800. It was a loss, I took it, and carried on. That's the honest thing to do, that's the LEGAL thing to do.

Spanky, I would call this guy back and tell him you have consulted a lawyer and are considering taking this up with small claims court, even give him a few details such as the $3k limit in NJ for small claims, so he'll know you're not BS'ing. What do you have to lose here? A good car at a good price. You won it fair and square, if you want the car, I seriously think you can get it.

If not, leave neg feedback. If he does the same, then sue him for slander. :)

either one of two ways you can handle this:

1) reply back saying "sorry to hear about your unfortunate circumstances about your old car and its transmission but since I won the auction you're obligated to sell it to me at the price. when you posted the item for sale you were given the option to set a reserve to weed out only the serious buyers and when I meant all the hurdles you threw down I qualified to purchase the car at the specified price. remember that"

or

2) reply back "hello, i'm sorry about your circumstances but I don't frankly care. you're obligated to sell the car to me throw the policy of EBAY. this has financial reprocussions on my behalf and I will fight this in small claims court if needed. when you posted the item for sale, you agreed to sell that item for the price specified. you shouldn't have posted the car if there was even a remote chance that what happened happened. once again, sorry for you but I want my car.

or you can mix the two :)

I think that would get him into more trouble, more than he wants to be in. This isn't some hooligan, this is probably an honest guy, doing a dishonest thing, and if he gets caught, he'll come clean real fast. If you threaten to sue in small claims court, I think he'll come around before you even need to do so. But, it's up to you and how much you want that car. I still think it's completely obvious what he's doing, and a judge would see it clear as day. He could have canceled that auction at any time, yet he waited until it's over? Give me an effin break. If it were me, and it's not, I wouldn't let him get away with it.
