See that depends entirely on context too. She said stop and he didn't notice? She said stop and he thrust out of spite 'cause he was irritated? What?

I absolutely agree that when a woman says stop, that means stop, immediately...but the justice does bring a valid point as to how "immediate" is "immediately". Perhaps the kid in the above was just bewildered at what and why and simply didn't pull out quick enough for the girl?
 
This is really another series of events that is emasculating American men. With the way laws are written it is only black and white. You meet a chick at a bar and both go to a hotel room and have sex, but her husband finds out the next day. Well you raped her. Guess what, you're a man and you are the one that is getting screwed now.

Ummm, that is what the trial is for. You make it sound black and white, not the law. The law being as complex as it is allows for leeway. That is part of why the law is such a good governing tool. It allows interpretation and good judgement. If it wasn't for what I was doing right now, I probably would love to study law. but I have to try what I am doing right now. Plus, there is always time later in life to look at my options. Come what may.

I love law and the intricacies of law, but I don't have a killer instinct. I never really did, so I would probably be a bad lawyer anyways.

actually the way you tell whether an ancient society was ruled by laws or social norms is to see whether there are inequitable cases at the extremes. if there are, then it was governed by law. if not, then it was governed by social norms.



anyway, i wouldn't want my future being determined by my word vs hers. which is what it comes down to (and why prior sexual history of the woman is important ,'oh yeah, she regularly spread her legs for any member of the lakers and begged for dirtpipe milkshakes' is easier to get out of, if you're kobe, than 'she was a quiet puritan girl who had never engaged in intercourse before').

Yeah, Law is a lot more complex nowadays than in ancient times.

Good line. It certainly wouldn't be right to continue with sex after the woman says no, but that is a different situation.
 
wonder if there are any sickos out there luring unsuspecting horn dogs, yelling no, then charging them with rape when it turns out they dont have the reflexes of a cat...

anywho, i think 60%+ of all rape cases is b/c girls feel slutty in the morning...its fcking rediculous >(
 
during sex, just keep asking her "What does S-T-O-P spell? What does N-O spell?" and during the trial, just say you thought her no's and stop's were just answers to your questions and not an indication to actually stop.
