It was Harry Reid who changed the rules for judicial appointees. It did not apply to the SCOTUS. Robert Bork was rejected by an honest vote, an act of common decency & respect withheld from Merrick Garland.

There was no Supreme Court vacancy to fill.

There was no nominee to consider.

The Senate never took a vote to adopt a rule to delay consideration of a nominee until after the election.

Nonetheless, Biden took to the floor in a speech addressing the Senate president to urge delay if a vacancy did appear. But he didn't argue for a delay until the next president began his term, as McConnell is doing. He said the nomination process should be put off until after the election, which was on Nov. 3, 1992.

McConnell broke the norms on appointment then trashed the filibuster to confirm Gorsuch. It's a pretty bad faith argument to justify flipping that around the other way because it's what you think the Democrats will do. It is however a good way to ensure the Dems take the same tack once they get some power back so it becomes a self-fulfilling prophecy.

A lot of the practical functioning of the republic is rooted in it's traditions and norms. If those are no longer impediments of any kind then shit is going to get out of hand.

It’s too late for that. The norm for this has been broken so now it has become just another partisan fight. If the Democrats take the senate they should refuse to confirm any judicial appointment except for those they submit, until they either retake the presidency or lose the Senate again.

Once your counterparty has shown they no longer wish to play by the rules of cooperation, continuing to cooperate no longer serves a purpose. It’s basic game theory - credible retaliation until their behavior improves.

For now, I'll take McConnell's word that he intends to do it again & as many times as possible, too. He'll pack the court with right wing ideologues & there's really nothing to be done other than to condemn it & vote the GOP out of power.

I'm not trying to justify anything. We are both saying the same thing with respect to what the Senate will most likely do.

Our only difference is you think the Democrats wouldn't do the same if the roles were reversed. I think that they would.

I personally think they should wait until after the election.

As I said it's now a self-fulfilling prophecy. So I guess you can point back at this when the Dems try to do something like pack the court and say "see".

The Senate should have functioned normally and moved appointments for presidents R and D alike instead of trying to bottle them up for partisan advantage.
