You do know that the attorney billed consumed at least few hours of his time(so if it was billed by hours, it's few thousand dollars of mental labor) and used his very education in the subject to file this suit. Being the money-hungry pigs they often are, they are not inclined to put in the effort unless there is a logical basis in law to attempt a case.
