I would argue that the TOS is wrong. The neighbor pays for a service, they should be able to use it or resell it however they see fit.

That would be like buying a case of beer and not being able to share it with your friends.

It is definately not like beer.
I is like paying for a all-you-can-eat buffet, but you sell part of all-you-can-eat to 3 other people. Yeah right, you can "resell it however they see fit". Bwahahha. There is no way in hell any restaurant owner would allow this.

But, you're not paying for unlimited download bandwidth though. You are paying for a set speed 1.5 meg down and 378 upload or whatever.

this is a very interesting legal question. IF i use someone elses wireless network and ONLY use it for Internet access and not to access their data, then the ONLY party being damaged is ACTUALLY the ISP. IF that is the case AND this person with the wireless network has it completely open, then couldn't you argue that the ISP should be suing the person with the unprotected wireless network?

IPSEC is easy and cheap. Unfortunately, it isn't included in these crappy home WAPs. There are plenty of FREE IPSEC implimentations.

Maybe, but why do things half assed?

i posted a scenario earlier where the ISP could come after the home owner with an unsecured network. If i have WEP enabled then they are less likely to come after me because i at least have made an attempt at security.

btw do you have a link to some of those IPSec implementations you are referring to. i'd like to try a few out.

Certainly any measure is better than nothing at all. I have my WAP outside of another firewall, so even if they did crack the WEP, get a MAC from an ARP broadcast to spoof it for my MAC filtering, etc., then all they'd be able to do is leach my bandwidth unless they authenticated against my VPN using IPSec.

If someone really wants to crack your WEP and spoof one of your MACs, they probably want more than just bandwidth, because they could just as easily go right down the street and find an unsecured wlan.
