fight it, but just do it yourself, do some research, get the facts right and try.

why not try?? it doesnt cost you anything but time.

MIKE

Well actually, somebody could make the argument that it does cost you more in time, and everybody else for that matter. In the form of our taxpayers $$ being wasted on frivolous court cases such as this. Me though, I'd gladly donate some of my taxpayers $$ just so you could go to court. Hell I wish I could take the day off from work so I could go with you just to hear the judge rip you a new one in regard to responsibility and lack of judgement regarding safety! ;) Now that would be worth a few dollars of my taxes for sure.

Here in chi-town, that is a $120 ticket, nothing more. Big deal, pay and move on. but impounding a car = go to court IMHO.

I heard if even 20% of the people contested their tickets, the whole revenue based on speeding fines system would collapse.

This happened in Masachusetts about a decade ago. Lawmakers passed some stupid bill about speeding, something about $10.00 per mile over a certian speed . This I believe was back when they still had 55mph around Boston and such, people who were doing 70mph on the highway were getting like $200.00 - $300.00 speeding tickets.

I remember hearing stories about how the state police while issuing tickets were just telling the people to bring it to court and contest it. I think that there were so many people contesting the tickets and tying up court-time, that this was one of the factors that they changed that law -perhaps somebody has a link or something/info?.

Ah that's great, I bet that cop was pissed. I love losing cops and messing with them. Two nights ago, I was driving along on a state highway, limit 55mph, and my radar detector went off, so I slowed down to about 15mph and kept driving along. Cop pulls out behind me, starts to follow me. I make an elaborate circle, and start to go the same way again when he finally turned off. Funny stuff. Hopefully I saved someone else a ticket.

He was doing 29 over in the middle of the night. Did he deserve a ticket? Yes. Did he deserve to get his car impounded? Unless he's not telling the whole story, Hell no! He should have gotten a ticket and speech from the officer, then sent on his way.

Years ago I got caught doing 84 in a 55...29 over also. Got a ticket, went to court and the judge was nice enough to reduce it. Paid my fine, took my points and went my way.

Anyways my advice is get a lawyer and get a laser defense system.
Lidar is one of the reasons I generally won't speed at night, no warning and dark cop cars are just about impossible to see until it's far too late.

The cop said the reason he impounded my car was due to the speed. He said any speed over 20mph the limit he has the rights to impound the car. The cop said I could go pick up my car the next day, which is what I did I had to pay 80 dollars. H ealso said he would think about taking my license, but when he dropped me off @ a gas station he gave it back and said keep it; if it was that serious he would have taken my license on the spot (they have the right to do that here in Ohio).

The over 20 mph impounding thing/losing license is on the book in many states, but it its typically only inforced if one or more of the people involved, cop or driver, are Aholes. Sounds like the county in which he pulled you might be hurting for revenue

$80 impounding
$50 towing
$100 court cost and lost day at work or $250 ticket and increased insurance premiums.
$100-300 in lawyer fees

You should have at least given the cop a reach around for giving you all that loving

Exactly how were you not at fault here?

Who was the victim?

No victim, no crime.

I am the victim. This dumbass does 94 in a 65 and ptenetially loses control of his car, BAM my insurance rates go up because of his stupidity. With the cops keeping people like him under control there are less auto accidents. Less auto accidents means less money insurance companies have to pay out.

I just beat a 78 in a 50.

1. What state are you in?
2. What code were you charged with violating?

The first thing to do is look up the law you were actually charged with breaking. Here in CA the most common speeding code is 22350 or the California Basic Speed Law. By this law, it is only speeding if you were driving at an unsafe speed given the current conditions. And the speed limit has to justified by a recent (in the past 5 years) traffic and engineering survey. I beat my ticket on the grounds of a speed trap through a trial by declaration (didn't even have to show up to court).

None of this probably helps you however as it doesn't sound like you are in CA and it doesn't sound like you were even charged with speeding but with wreckless endangerment or something along those lines. Anyway, read the law you were charged with violating and see if there is anything in that wording that you can prove you didn't do.

So now it's fair to penalize people for potential accidents?

You know, there is always the possibility that you will lose control of your car and smash into a tree, even when you are driving the legal limit. The only way to be 100% safe is to never drive.

Should DUI be legal then? By your reasoning it should be.

EDIT: I guess we shouldn't punish anybody for potential anything. Should we punish people for having fire exits that are against fire code, or should we wait until there are horrible disasters like there were last year that kill dozens?

In a perfect world the penalty for causing damage and death would be enough to discourage irresponsible behavior on it's own.
