I wonder why they keep saying that they used thermal imagery from the chopper to determine that the suspect was in the boat, yet they are also saying that a guy lifted the tarp on the boat and actually saw him hiding in the boat before he called the cops.

Unless they mean they were just verifying that he was still there after they arrived on scene.

I would be running so fast after seeing this kid hiding in the boat. That guy is really lucky he didn't get shot after lifting that tarp up.

I forgot what the question was but they were saying they were using the thermal to confirm whether he was still moving/alive after the shootout with police and subsequent flashbangs.

Thermal imagery is not xray vision.
 
Now that I am thinking about it. If hes a US citizen, it might be hard for the feds to use the terrorism charges under the Federal Penal Code. There might not be a death penalty eligible crime they can charge him with under Federal Law.

McVeigh got the death pen, charge this dude with what he got

Even if he died, his body would have stayed warm for a while. But I understand them using it to see him moving.

They can't claim jurisdiction the same way they did for McVeigh because McVeigh attacked a federal building + killed federal employees(including law enforcement).

Im not saying its impossible for the Feds to get jurisdicition of dp eligible crimes. It would have been alot easier if he was not a US citizen or if he had killed federal law enforcement/attacked US buildings.

It will be interesting to see what the feds charge him with.

Well.... if he was under the tarp....

There might have been very small things that thermal imaging picked up once they knew where to look.

His hand is under his back because he is in cuffs.

because of what he did, the suspects have been in federal jurisdiction since Monday.
 
Lemme quip in with a bit of medical advice/knowledge...

Generally hospital ERs have 5 "conditions" you are in. Expired(dead), critical, serious, guarded and stable/fair.

Serious condition generally means you've got injuries but generally nothing immediately life/limb threatening. Say he has a gunshot wound to the arm or leg, but bleeding is controlled, no sign of neurovascular compromise, then you'd be in serious condition.

Who ever is working on him needs a break, they look stressed out. Go have a cup of coffee or some dinner, come back 5 hours later after you have relaxed a bit.

The Public Safety Exception doesn't mean that he has to talk, just that if he does things he says can be used at trial. All it means is that they can non-coercively question him about very specific things only.

Are there more bombs? Do you have more accomplices? Are you part of a larger group? Do you know of any planned attacks?

Some of the news outlets are reporting this as if they are going to torture him and that's OK.

Based on his condition I don't think they are going to get to meaningfully exercise this.
