The US copyright laws only apply to works created by the US government, not city, county, or state governments.
This may or may not be true but Georgia has its own law around mug shots:
--
Of course one could argue that a donation is not commercial use... after all it is non-profit.
---
Does The Georgia Mugshot Law Protect You?
Officials may only release mugshots to those who sign a statement, which protects the information from commercial use.

The Georgia mugshots law states that:

A “booking photograph” is any photograph taken by an arresting law enforcement agency for the purpose of identification when such an individual is processed into jail.
Except when the case qualifies for the State Sexual Offender Registry, the law enforcement agency shall not post booking photographs on a website.
The arresting agency shall not provide or make copies of a booking photograph when:
That photograph will show up in a publication or website, or when
Removal of those images requires payment or any other consideration.
When a person requests a mugshot, they shall submit a statement affirming compliance with subsection (c) of this Code section. Any person who knowingly makes a false statement is guilty of breaking the law.
Georgia made a statement with this law and took action to combat a serious problem. With any luck, this Georgia mugshots law is enough to end this business model in the future.

Mug shots, like most government works shouldn't have a copyright period. Anyone should be able to do what ever they want with that picture.
But without such copy right, criminals can make monetary gains from their crimes, just as Trump has done here..

I'm sure he can prove that by submitting the flow of cash from those sales to his political campaign finances, and from his political campaign finances to strictly legitimate campaign costs.
That is a different matter and I think someone was investigating him for improper use of campaign funds. Having said that I find it disgusting that tax free donations can be use for lawyer cost to defend him against criminal charges.

True, but the value of selling a mug shot is pretty much zero for nearly all criminals. I think it would be similar to a criminal writing a book.

But I think it is fine to release them with a no-commercial use license as well. Just in general I am a pretty hardcore believer in public domain.

What? Trump just made $7 Million off of his illegal use of the Mug shot. Mug shots are already public domain, where they can be used for Meme's, media, etc.. They cannot be used for commercial use (monetary gain) as Trump has done.

Technically he is not making money as it is a political donation which is tax free.
Technically, that's a horse shit argument. Specially since the "political donations" are being used to fund his legal battle(s). Which I am pretty sure is a violation of campaign finance laws as well. If he is using the money to fund his legal battle(s), then it's not longer considered donations, and becomes income by IRS standards, which is taxable, and makes it copy right infringement.

Social media has rotted his brain because he used to be much better. He reminds me of Dennis miller who used to be really funny as well, until he went off the right wing deep end.
Sorry. Dennis Miller was NEVER funny.

The Australian billionaire he shared information with about our nuclear subs apparently repeated what Trump told him to dozens of people, through e-mails and texts. He told him how many warheads the subs carry, and how close they can get to Russian subs without being detected. Sounds like another easily provable charge to add to the docs case.

Sure sounds like justification for a treason charge to me.
