- 11-0215. Animals and fowl; nuisance, defined and prohibited.
- The keeping of any animal or fowl which causes annoyance, disturbance or offense to persons residing in, or passing through the neighborhood, either by reason of:
-
(1) Barking, howling, braying, crowing, or other sound common to its species; or
(2) Biting, threatening, chasing or molesting persons upon the public sidewalks or streets, or the property of persons other than the owner; or
(3) By reason of the failure of the owner to maintain all structures, pens, coops or yards wherein any animal or fowl is kept, in a clean and sanitary condition devoid of rodents and vermin, and free from all objectionable odors; or
(4) Keeping any animal or fowl in violation of any provision of this section is hereby declared to be a nuisance and the keeping or maintaining of such nuisance is hereby prohibited. Each day's continuance of such nuisance shall be a separate offense.

- SEC. 9.21. DOG AND CAT REGULATION AND LICENSING.
Subd. 7. Other Unlawful Acts. It is a petty misdemeanor for the owner or person having custody or control of any dog or cat to:
(1) fail to have the license tag issued by the City firmly attached to a collar worn at all times by the licensed animal, or
(2) own or keep a dog or cat which is dangerous (any such animal which has caused injury to persons or property shall be deemed "dangerous"), or
(3) interfere with any police officer, or other City employee, in the performance of their duty to enforce this Section, or
(4) fail to keep such dog from barking, howling or whining, or such cat from emitting loud or unusual noise, or
(5) fail to prevent such dog or cat from defecating in or upon any school ground, public street, sidewalk, alley, tree bank (berm), park or any other public ground or any private property within the City, other than the premises of the owner or person having custody or control of such dog or cat, or
(6) fail to immediately remove the feces of such dog or cat that defecates on public property or otherwise in violation of the prohibition contained in the preceding paragraph, or
(7) permit the feces of a dog or cat to accumulate for more than twenty-four hours on the owner's premises or the premises of the person having custody or control of such dog or cat.
