The "mores" or "established procedures" of any one culture or grouping or "sub-culture" are often not written down on a placard, but are easily learned and absorbed during one's active participation in that "group", aided solely by one's common sense and willingness and ability to learn and absorb from those around you.

You would have expended less energy and created less drama by the simple and relatively easy act of learning this, especially aided by your law training, as opposed to not thinking it through and coming here and complaining about it.

ill probably be selling some shit on the FS/T forum soon, so it's good to read this and be prepared for flaky buyers. im obviously new at this and never sold stuff before so im not familiar with the "norm" of internet used sales.

How did the potential buyer "back out"? To "back out" there would have to be an agreed upon deal in place. Thats the problem. MotionMan assumes that by simply agreeing to a price that that constitutes an agreement which is does not. He's just whining.

You know, that raises an interesting point:

If the guy in my example had simply sent me money without us agreeing on anything else, like shipping terms, under our established procedures, do we have a deal?

RANT: Why do the other girls in my HS secretly abort their babies in the Girls Room and then never clean up their placenta and afterbirth?

WHINE: Why is the toilet paper in my executive wash room only two ply and not four ply?

^^^ Examples stretched to the wretchedly absurd so that even a lawyer can't argue the difference. ;)

Nope.... I'm pretty sure it was a whine. I've got 2 little kids and that's pretty much what they sound like.

As it has already been stated, accepting an offer does not mean that there is a deal. Some people shop around, and part of shopping around involves inquiring about prices. Making a decision can take a couple of days, and so the individual inquiring about the price should let the seller know whether or not he or she will respond in a few days or if he or she plans to buy the item at all, but this is just etiquette. The seller should assume that there is no sale until the buyer clearly states that he or she will buy or until payment has been received.

Who the Hell makes a payment before nailing down shipping options, unless the seller is paying for shipping no matter what method is used?

I have had the following happen on many occasions:

1. I receive an inquiry PM asking if I will take $XXXX.
2. I respond to the PM in affirmative and provide my PayPal info
3. I receive a payment of $XXXX via PayPal with the buyers shipping info
4. I will usually then ship the item.

So, did we have a deal at the end of step 3?
