Which, as I explained, would not turn a resulting death into felony murder, because assault can't be the basis for felony murder.

If they made coal rolling itself a felony without calling it an assault, that would work.

I saw a car roll though a stop sign making a turn in SF once that tipped a messenger off his bike. The biker smashed out two windows on the woman's passenger side with his bike chain , yelled "pay more fucking attention", and rode off. I considered my long held instincts not to at all mess with messengers confirmed valid.

There was a case in SF I think about 5 years ago where one of those messengers was riding his bike down one of those ridiculously steep hills in SF and collided with a woman standing at a street corner, killing her. A very rare occurrence for people to be killed by a speeding bicycle, but people who don't like the cyclists were all over it.

I don't recall if he was a messenger or not but he was convicted, which is more than I can usually say for drivers.

Yes I recall him being charged with manslaughter. Most automobile accidents involve ordinary negligence (i.e. briefly taking your eyes off the road to adjust your radio). This subjects you to civil but not criminal liability. This cyclist IIRC was doing 40 mph on his bike, on crowded city streets. That is reckless.

I don't drive much, like 15 miles every 2 weeks on a designated day. I do skate 10 miles/day up and down a designated "Safe Street" that's marked by signs saying "Emergency vehicles and bicycles only" and 15mph. They basically permit people who live on the street to drive. I've been doing this for over a year. This is liberal Berkeley, CA. But there are some redneck drivers here too. I think it's something about "motor vehicles" that brings out the asshole in a lot of people. I've had guys pretend to come after me, yell at me. The signs have been vehicularly vandalized. Evidently, someone ran into all 3 of them, destroyed one completely and the 2 others have been repaired multiple times by citizens, not the city. The citizens are me and this other guy, a little immigrant kind of guy with a lot of spunk. He actually screwed the base of one sign into the asphalt, fixed another to the asphalt with caulk. The 2 remaining signs were bent over 30 degrees last week and the little guy straightened them up again. Someone could hit me skating or shoot me but I'm going to continue.

Vanishingly rare event, though does happen every now and then. If a bicyclist hits a pedestrian it's about as likely that the cyclist would die as the pedestrian.

Bike messengers have the same bad incentives to break the rules as do delivery drivers. Piece-work and intense competition will do that.

Increasing problem now seems to be these new electric scooters, skateboards and powered bicycles. Doesn't seem to be anywhere they fit in, either among car traffic, on bike lanes, or footpaths. Really annoys me when they whiz past me on the footway - both anti-social _and_ lazy. Can't even be bothered to pedal.
 
I remembered an accident where a girl was changing her cassette tape while driving and plowed into 4 cyclists and killed them all. She never went to jail.

One difference is that sounds like basic negligence as opposed to recklessness with intent to intimidate. Also 34 years ago.

-Pretty crazy the DA only found out about this from people contacting him on social media, not from the fucking blue lives people.
 
The young man is probably just suffering from affluenza, it's a chronic disease that affects the heart and brain.

Hopefully so his family is worth sueing.

More likely he has state minimum insurance and isn't worth shit compared to 6 people.

This is why I bumped up my under/uninsured insurance to $1M, much rather depend on myself to have adequate coverage than Dave asshole on the road.

Well he was driving what looked to be a pretty new big assed pickup truck, so that's like 50K or more right there. Maybe they do have money or maybe they are car rich and cash poor.

Looks like a cheaper F250, probably a 2011-2013, XL or XLT.

In Texas it's also not uncommon to have 200K of vehicles in the driveway of a 50K trailer.

read in that article the daughter of one of the couples sued the winery who owned the vehicle and settled out of court, I suspect the same thing will happen here as I'm sure, being 16, the truck was either owned or given to him by his parents.

IMO, he should lose his license at least until he turns 21 due to reckless driving.
