That's what he needs to do. If it's not supposed to show up on your record, you need to talk to the proper channels and have it expunged.
I was not prosecuted because there was no evidence because I did not commit the crime they allege I did.
This is not something that shows up on a criminal record check.
It took me hours at the police station to even find a record that mentioned this incident. The record retrieved is only accessible by me.
The employer found it by processing a fingerprint background check.
My fingerprints were associated with this. They want me to prove I didn't get charged, and due to the uncooperativeness of local courts that's difficult.
I gave them the report that says all the police did with me was let me go.
This is not a sealed record because there is no record to seal. There is a simple arrest and then letting me go.
A nice country this place will be when the very allegation of a crime can blacklist someone for life.

What kind of job and company is it that you had to do a fingerprint check. IIRC most jobs require you to pass a clear background check, at least in my experience.

They shouldn't be allowed to ask and I shouldn't be expected to explain.
It's an arrest. If there were something to explain, there would be charges and a prosecution.
Hell, what are you applying to be? If it's an officer with the CIA, or an NSA language person, that might be one thing. But companies are going WAY overboard with background checks lately.
If you were a hot blonde chick with huge tits and had been arrested for multiple indecent exposures, I would think a background check would be an advantage.
If you indicated that you've never commited a crime and an arrest shows up on your record....I'd say they have the right to ask and investigate. Hell they don't even have to hire you or move forward at all. Sounds like they are being nice by even looking into it! You seem to think the world owes you something. Personally, It sounds like you got away with something because of lack of evidence and now it's rearing it's ugly head. Just because you were released doesn't necessarily mean the arrest will not show up on your record. Did you hire an attorney when it happened and have all evidence of the arrest removed from your record? This just sounds so fishy.
Either way, the company found something and you have no reason to be mad at them. At this point, the best thing for everyone is to move on. They shouldn't hire you and you should clear your record and look for another job. Even if they hired you, the entire time you are there they will think you possibly did something.

He has zero criminal record. An arrest is not a criminal record.
He received a written letter from the company (probably signed by them too), saying that they would not retract unless they found a drug test failure or conviction.
He could argue that the company would be breaking that contract.
They did not ask me to list arrests.

I'm guessing this whole burglary thing wasn't a big deal. If it is, my guess is that the prosecutor might not write it for you if they wish to charge you at some point.
I'm going to take this as a lesson for myself to always get the lawyers involved if i ever get arrested or released.

I am a bit defensive considering I'm totally at the mercy of the judgement of this company, AFTER they convinced me it was a done deal.
i think they can refuse to hire you if they want...they decided to run a background check...and they didn't like what they found. even if you do fight it...and u do get hired...u'll be on HR's hit list.
An arrest should not, and according to wiki is not, an acceptable reason to refuse to hire someone.
