The more I learn about this case and in particular the more of the trial testimony I see, the more and more I lean toward this scenario:
Davis flips out over the request to turn down the music, though the other two in the car do not. His best friend said he'd seen Davis flip out before. They admit he was getting more and more upset about it without any interaction with Dunn. They admit Dunn asked politely if they'd turn down the music, and that they never heard him curse or yell. They admit Jordan re-engaged with Dunn through the window, and escalated the situation.
I believe Davis got carried away in a tantrum of anger about the request, and a desire to impress his friends by acting like a badass and scaring off this old white guy he perceived as a pushover. I think Davis' envisioned scenario was Dunn gets scared, drives away having peed his pants, and then Davis gets to brag and has a good story out of the deal.
I think Davis did eventually resort to outright threats on Dunn's life. I think he did not mean this literally. I think he was just trying to intimidate and scare Dunn. Prove how hard he was. I think Dunn made up the shotgun thing to try to solidify his self-defense claim, but I believe that at the time he shot he was in legitimate fear for his life. I think he mistook a bluster/bluff/posturing "threat" for a real threat on his life.
I think there is a possibility Davis decided to grab the camera tripod which was in the truck and stick it out the window to pretend it was a shotgun, and scare Dunn with it. However, as I said, I consider it more likely that Dunn just outright bullshitted up the gun thing. Find this hard to consider as a possibility? Keep in mind the times kids have gotten shot with toy guns by cops, after pointing them at the cop, etc. I have seen teenagers do shit this stupid. Is it any stupider than throwing rocks at passing cars?
I think Dunn got carried away himself once his fear was triggered, and I think he went overboard with the number of shots he fired and how he continued to fire at the truck as it was driving off.
I think he should probably be convicted of firing into an occupied vehicle, but nothing else.
I reserve the right to change my tune as the trial progresses, but as I said this is the theory I am *leaning* toward at the moment. Admittedly I change my mind a lot on this case. It's a much more complex and frustrating case to settle on an opinion with than most of these are.
