That's one person's story. You have more witnesses that disagree with that story and why Dunn is being charged with second degree murder and has had bail denied.

That doesnt mean he's guilty.

But yes I agree theres more to this. Gotta keep reading the thread and the news.

would be fitting if he's found guilty to wind up in prison with a big ass cellmate who forces him to listen to a Walkman with rap music at very high volumes.

You're both right. The judge or jury has to find self-defense specifically. If it got kicked for not proving the elements of the crime or lack of positive identification, I believe the civil immunity wouldn't attach.

We're into unchartered territory though, the way the law is written may not be how it is used in practice, and that can cut either way.

I didn't want to create a new thread, so I decided to post this here since Spidey has mentioned Crystal Scott numerous times in order to prove some kind of point.

Murder or self-defense? A jury will have to decide after a 23-year-old single mother was indicted on Tuesday afternoon following a case of road rage.
The incident happened back in September of last year. 23-year-old Crystal Scott fired her weapon at Johnathan Ables after a fender bender off FM 1960. Initially, police believed Scott acted in self-defense but a grand jury decided otherwise.
"Can you imagine a 23-year-old girl working every day and going to college raising a 7-year-old and now faced with murder," said Scott's attorney Letitia Quinones. She also mentioned Scott has been seeking counseling since the whole ordeal and in which she said, Johnathan Ables hit her vehicle from behind.
Like any law-abiding citizen, the single mother pulled over and called police but Quinones explains what happened next: "When Crystal pulled over into that gas station, he jumped out of his vehicle, he charged her vehicle, began beating on her vehicle, started screaming profanities at her and tried to open her door."
In fear of her life, Quinones said Scott, who is licensed to carry, fired her weapon, fatally shooting Ables. At the time, investigators found the 23-year-old acted in self -defense, but after presenting all evidence to a grand jury on Tuesday, the court found otherwise.
"Having a concealed handgun license is not a license to kill and if you believe you have immunity merely because you carry around a little piece of paper in your pocket, you're ultimately going to be called upon to answer for that in a Harris County criminal district courtroom," said Brian Wice, who represents the Ables family.
Wice wouldn't elaborate on what type of evidence was presented before the indictment was handed down, but it was enough to go from finding Scott acting in self-defense to a charge of murder.

So, what do you make of this Spidey? Is she being "unfairly railroaded" like you claim Zimmerman and Dunn are, or did she lie? Was this Ables guy a thug in deep cover who had it coming, or was the shooting not justified?

Sounds like she's being unfairly railroaded. Sounds like a perfectly legal shoot to me, you can't attempt to enter another's occupied vehicle or force entry - it's the same as trying to forcefully enter somebody's home.

So, what do you make of this Spidey? Is she being "unfairly railroaded" like you claim Zimmerman and Dunn are, or did she lie? Was this Ables guy a thug in deep cover who had it coming, or was the shooting not justified?

I'll bite. Based on what we know, it seems she is being railroaded. Maybe there is a smoking gun we don't know about that says she didn't have a reasonable fear for her life.

Maybe she brandished her weapon prior to firing and someone witnessed it? As has been discussed multiple times in the Zimmerman thread, brandishing is a crime and can preclude a self defense claim.

I think she went overboard. Not sure if it's murder, but maybe manslaughter. I'm not sure how the law pertains to this, but the guy was outside her vehicle, was unarmed (I believe), and there was still a door and a window separating them. He wasn't in the process of committing a felony I don't believe, unless trying to open someone's car door (I believe that's supposedly what he did) is considered a felony.

In Texas and some 24+ other states your occupied vehicle is treated the same as your house, castle doctrine extends specifically by law to your occupied vehicle.

So if somebody is trying to forcefully enter you can shoot, exactly the same as if somebody is trying to forcefully enter your residence.
