No

Is it credible?
No

Is it capable?
Yes.

Deadly force is not justified. You are missing the biggest piece of imminent and credible. Also remember I never made a direct threat. Even over the intarweb.

All of this is explained in state sanctioned ccdw classes. 2 hours were devoted to the verbal aspect alone.

I suggest you learn your states laws on self defense.

What threat have I ever made to you personally, in person, having the means to carry out that threat via proximity or disparity of force?

See where reasonable person comes into play?

I gotta give to spidey for his pretty much unwavering ability to be courteous and respectful even when he says the craziest things and is argued relentlessly for them. Shooting somebody dead for hitting on you is pretty good stuff.

That's why I have such a hard time arguing with him. He is polite and courteous while being a pompous ass. And to be fair...He is only exercising his free speech. Even if it offends me to the bone, he is just expressing his feelings.

Jello is the kind of shit people that deserve to be shot both sell and eat. It's just kool-aid for people on weed; those people probably put cough syrup in the grape flavor and call if purple-stickey-wigglers.

If someone offers me Jello they're probably trying to dope me and thus I can stand my ground if I perceive a credible wiggly threat.

Juror said she didn't think it was 1st degree so no conviction. Could they not consider a lesser charge of 2nd?

They did. The charge of first degree, in the case that just concluded, included lesser included charges of 2nd degree and manslaughter. In other words, the jury could have found Dunn guilty of 2nd degree if they felt 1st was not warranted. However, the jury was split amongst members believing he was guilty of one of the three charges and three jurors who felt he was not guilty of any of the charges.

If all 12 had believed he was guilty of some crime regarding Davis they would have convicted of a lesser charge. Since Florida allows lesser included charges, I think the strategy is always to go in with the highest possible charge and let the jury consider the range of charges. I don't know if that strategy will change in the retrial.
 
So many people tried to compare the facts between the two cases but the only real similarity I see is the DA overcharged again and it cost them the case. I wonder if Corey felt like she had to win big after losing the GZ case. It sounds like if Dunn had been charged with manslaughter or Murder 2, he would be sitting in jail right now like he should be.
