nope. wouldn't she get charged with child molestation?

That does raise an interesting question. If some or all of the pictures were of her touching herself, would they charge her with child molestation along with possessing child porn? hummmmm I would be interested in knowing how this flows thorugh the legal system. I bet lawyers are lined up wanting to take this case.

...

Stupid bitch.

This girl obviously needs therapy.

People can be stupid when they are young, but not as stupid as this girl.

This is the part I find truly bizarre.... she's being charged with possession and distribution of child pornography --- for taking explicit pictures of herself?? Is it just me, or does it make absolutely no sense to charge someone with possession of child pornography for having pictures of themselves?

I can understand if some slimy creep took pics of her or something -- then he could be charged with something.... but to charge her with a crime for taking pics of herself? What the heck?? What about looking at herself in the mirror naked -- does that constitute engaging in child porn as well?

according to their interpretation of the law, apparently yes.

This has to be misinterpetation of the Law or use of the WRONG Law in this case.

Is the Law is in place only to protect children from adults exploiting children?

Does the Law specifically have guidelines for exploiting yourself???

New Cans of Worms opened everyday as we get overloaded with TOO many Laws.

Treat the kid as a kid and not as a Sex Offending, child expoliting monster against herself. :|

In PA, this is covered in the CPSL (Child Protective Service Law). You can be 12, and be indicated as a sex offender. This is different from being convicted. I am not sure if it can be used against yourself like this. I don't have the CPSL laying around here, its on my desk at work but I will find out tomorrow.

BTW I work for Children and Youth, and feel sure the charges are to force her and her parents into counseling.

Does that mean if I photograph myself masturbating it would be considered gay porn?

Please, just destroy the camera and the flash memory in it.
Oh wait, I'm sorry. That's not the usual Anandtech Off Topic response. It should have been:

Ok it isn't covered under the CPSL, because a family or household member wasn't involved. The reasoning behind the charges is to get her into court ordered treatment. If a person on the internet asked for the photos they could be charged with child abuse. This is from the director of our agency.
