And shooting at unverified targets is a bad practice in any situation. This is why more civilians need fucking training. Should have been a little high powered LED light on that gun if they were gonna use it for home defense.

Nothing says he didn't identify his target.

In my home at 2:30 in the morning after alarm going off = you are threat and already identified.

And 16 is no child. We've got 14 and 15 year olds running around raping and murdering people. He was capable of breaking and entering, that's no child.

I experimented with alcohol, decided to speed up my research and got enough funding to embark on a really ambitious project to drink all the beer, bourbon and tequila on the east coast. It didn't work, but it wasn't for a lack of effort. And in all that time I never once forgot where my house was and I never once climbed through ANY window let alone one that didn't belong to me. For that matter I've never even seen a person that was capable of walking and climbing being so drunk as to not recognize his own house. That level of incoherence is always accompanied by being curled up in a ball on the floor puking all over yourself.
Depends on the individual, alcohol metabolism is highly variable and then you have combining another drug, which is extremely common. One time, when coming home from a party, I was a little drunk (not excessively), a little high (not excessively), and also very tired as I had been up for about 22 hours. I was 17 miles from home but realized I was only five miles from a friend's house, who still lived with his parents. So I decided to go there and crash instead. I got into his driveway really barely awake, and thought "Shit, its 2AM, I can't go waking everyone up, so I'll just crash in the car." This was before cell phones (well, technically they existed but were very expensive and service was very limited so not many people had them).

I woke-up a few hours later, minutes before day break, shivering cold. I sat-up and initially didn't realize where I was, then I remembered "Oh yeah." Well except I wasn't in my friend's driveway. I was in the driveway of the house next door. And these weren't tract houses, townhouses, or condos, either. Every property had at least 3/4 acre with their own driveway to the street. Their houses looked nothing alike. Feeling much better and less drunk, I started my car and backed-out before anyone noticed.

In my house after breaking in = you are now an identified target and I know what is beyond said target. It's my house so I already know what's beyond.

In house illegally = already identified threat.

It's the same as shooting through the window or door as the threat is trying to break in. You've identified it as a threat, you don't have to ask it who or what it's intention is.

Wait, so according to you, you should have a bright flash light on your gun, thereby identifying YOUR location; you also want to wait and identify someone that has just broken into your home, whose intention you don't know, but you do know that the person has just broken into your home, in the middle of the night... Now imagine that person, with a weapon, with really bad intentions...

I'm sorry, did the shooter say he shot into shadows or are we assuming this? Did I miss something or are you making up facts just like the people you are arguing with?

I've never been a fan of the American fantasy to kill with a gun but I have to say I do agree with castle laws and I think this was justified. Good shoot!

I wish this law existed in Canada too, except here we'd beat the living crap out of them with a hockey stick, tie them up and throw them in the snow outside and let them freeze to death or get eaten by a bear, whatever comes first.

That's utter nonsense. If a person BREAKS INTO a house in the middle of the night the homeowner is under no obligation to make sure it isn't a girl scout who took a wrong turn while delivering cookies. In fact, any homeowner who even attempts to try to discern exactly who the target might be by shining a light that points back at himself is an idiot, that gives the illegal intruder the chance to make the first move. Exactly what percentage of break-ins are lost and drunk neighbor kids? .00000001% maybe? If someone breaks into your house it is normal and natural to believe that they need to be shot and it's common sense to shoot before giving them a chance to shoot back.

I remember this one time at band camp* I got so trashed that I went to bed** on a Friday night, or thereof, and woke up on Sunday afternoon. I still had my wherewithal to recognize which bed was mine. I've seen Little Foot ran in front of me on the freeway in front of my car, yet I made it home. I don't know how trashed you have to be to not recognize your own home.

*not band camp, more like deployment
**not a bed, but a cot in a GP tent shared with 9 other cots

I got so fucked up once that I don't even remember how I got home. Someone called my wife and had her come pick me up... boy was she pissed. I've never been that drunk before or since but I literally have no memory of that night after a certain point.

Exactly. Point being don't break into houses. Don't break into a bears home, else you're head gets taken off immediately. This should be common sense

I take exception to all this talk about "well I've been fucked up before and have never mistaken my house." So what? Why exactly is your body's reaction to excessive amounts of alcohol fit to serve as a metric for the rest of the populace? I've seen 5ft women weighing maybe 110lbs down beers and shot after shot of tequila, then go play volleyball for hours in the sun and not look trashed at all. One of my college roomates was gigantic, but couldn't handle his drink if his life depended on it and would turn beet red in the face for the rest of the night after 2 beers. Using my huge ex-housemate as a baseline to judge all other reactions and tolerances to alcohol seems stupid, no?

Why is it so hard to believe this kid was just really messed up? I'd like to think that warning shot would have clued him in. In an altered state of mind it's common to imagine sounds, did he freeze when the shot fired and thought "Did I just hear a fucking gun?" while the shooter took the calm reaction as an indication of intent and promptly sent the next one downrange? Was it really a warning shot or just the first round fired which missed? If you're worried for family in your own home facing an intruder, I'm not sure why you'd give that person the benefit of getting a bearing on you and thus the chance to respond with their own weapon. Recon by fire and using a gun to communicate are the tactics of idiots for the most part, certainly in this situation.

The neighbor, while acting appropriately given the circumstances, is going to be haunted about this for the rest of his life. The father is probably destroyed.

People have done much stupider things when trashed, I think that alone should be reason enough not to be so fucking cold about this teen checking out at 16.

My stepdad said that about bear wrestling once. About a year later he got his wish while tending a bear bait.

Extra holes and cooked organs and spinal fluid are really overrated btw, same as bear wrestling.

To those saying he should have had a light and made effort to identify target you are idiots.

Had this been a criminal breaking in and he was armed which most criminals are all shining a light at him is going to do is identify YOUR posistion and since you would be wasting time "trying to identify" him he would shoot you DEAD in a heartbeat because the criminal has ZERO INTREST in identifying you and would not hesitate or wait for you to finish your identification.

The bottom line of this whole thing is the kid fucked up, had at least 7 ways to save his own life prior to it reaching the point it did and still ended up getting shot. Im sorry but the blame in this case is solely 100% on the kid he had 7+ ways out but didnt take them.

The kid could have:

1. Realized it was not his house from the street.

2. Realized the yard was not the same as his

3. Realized the window he was trying to enter had a secured screen which im assuming his own window did not or he would not be attempting to enter it.

4. Realized the room he entered was not his or one that was in his house.

5. Realized the alarm going off was not the same as the one in his house if his even had a alarm.

6. Realized the hall/stairs outside the room he entered was not in his house.

7. Realize SOMEONE FIRED A FUCKING WARNING SHOT at him.

I can't count how many times people in college ended up in the wrong dorm room or whatever after a night of drinking like retards. Also plenty of stories of people pissing in the wrong room (i.e. wrong turn and end up peeing in someone else's room). The video shows houses that look somewhat similar as well.

It's obviously very possible for some wasted 16 year old to have made the mistake of trying to get into the wrong window.

Wrong house, no. Accidental B&E isn't a thing, and even if it were the conclusion is the same, someone who comes in through the window is assumed to be an invader. Maybe you'd invite him to a cup of tea and he turns out to be a burglar. You know the types of burglars who break in at night when people are home? The rapey murdery kind.

People who break in at night plan on two things because the person is at home. Most burglars who break in during the day hope to avoid conflict. They are the types you could negotiate with. The ones who break in at night plan to:

1. rape
2. murder

Probably 1 & 2. Thats how the world works. Think about it long and hard why someone would break in at night as oppose to the day when 90% are at work.

You go ahead and take that risk. Someone came in through the window at 2:30am and the alarm is ringing. Who knows what his intentions were. By the time you stop and ask you can be dead. I've actually been in a crime at gunpoint (robbed) so I actually know what its like. There really isn't time to ask questions, its all snap decisions. Enough is there (breaking in window, 2:30am, guy B&E) that its safe to assume their intentions are not good.

The way I was robbed, I was on the opposite side of the street. They looked like rather shady guys. I was on the opposite side of the street on purpose. And instead of running I tried to keep cool. And it was the wrong decision. Just like that. They popped up hoods/bandanas they had hidden under their shirts and sprinted across the street gun drawn.

Once I had the gun on me, I'm like 50 feet to the nearest shop or place of safety. Too far. Just like that you can be dead dude. If he decided to do it, I'd be gone. You go ahead and play 20 questions with the guy breaking into your home dumbass. I know better, lol.

Of course someone would be assumed to be an invader, and I in no way disagree with the shooter's actions.

That said it was obviously a case of mistaken property. The police have said as much, it has since been revealed that the staircase is exactly the same, the carpet is exactly the same, they have the same fence, the same backyard, are 2 doors away from eachother, have the same model house, etc. and he has been living there less than a year.

The kid is not going to party until 2:30am to go rob a place 2 doors from his own fucking house, then continue to enter the house after the alarm goes off, then continue to advance on someone who is firing warning shots at him.

He was blacked out of his mind. It's tragic but ultimately he put himself in that situation. My heart goes out to his family, his father in particular is being an incredibly level headed man in all of this.
