Accused Border Guard Defends Beating Tourist

The attorney for Customs and Immigration Inspector Robert Rhodes says he was only doing his job when he pepper-sprayed and beat a tourist at the Rainbow Bridge on July 21.

"She fought him. She kicked him and she scratched him,' says Steve Cohen. "My client attempted to subdue her."

Rhodes is charged with violating the civil rights of 37-year-old Yan Zhao, a Chinese national who was visiting Niagara Falls on a bus tour. If convicted, he faces up to 10 years in prison and a $250,000 fine.

The woman displayed black eyes and facial bruises two days after the incident. She says Rhodes mistook her for a drug suspect, sprayed her with mace, slammed her into a wall, kneed her in the head, grabbed her hair and slammed her head into the ground twice.

Attorney Cohen tells Rich Kellman there's more to the story. He says Yan Zao refused to stop when Rhodes ordered her to and then fought him. "When a customs officer tells you that you're about to be inspected," says Cohen, "you submit to that inspection or prepare to be met with whatever degree of force is necessary to get you to comply."

Kellman notes, "Take a look at some of those pictures and it does raise the question, it seems to me," how much force is necessary? Grabbing her hair and striking her head with his knee? Striking her head on the ground?

Cohen replies, "This man's protecting our border. That's what these people do. This woman was not about to cooperate."

The case has grabbed headlines in China. The Chinese foreign minister demanded that Secretary of State Collin Powell make sure justice is done.

Cohen says that's also what his client wants. "I have the United States Constitution on my side, and I intend to represent my client armed with the Constitution, and politics be damned."

Cohen says he hopes to question all witnesses, including other security officers, and wants access to any surveillance tapes of the incident.

Rhodes is due back in Federal Court on September 20.

Give a person a uniform or an important sounding title and he becomes god.

Law enforcement and soldiers need to be paid MUCH MORE and required to have advanced education so that the dregs of society won't be attracted to those positions.

Second comment: I agree they should be paid more, but why require a Masters degree? I know that many police departments now require at least a bachelor's degree.

maybe those border cops need to sit in a bigger booth. sitting hours in those little phone booth type of rooms as checkpoints probably made them edgy and cranky.
 

She refused to stop for a required inspection. What should he have done? Let a suspected drug runner cross the border without submitting to a search? If that's how all law enforcement worked, we'd have one hell of a border security problem.

This sort of violence in law enforcement is rarely if ever necessary. He violated the trust put in him by society to a blindingly harsh degree. Just as criminal, even more so, than those they arrest. Best bet with a cop like that, since rehabilitation probably wont work, is to put them against the wall and get rid of them before they do more harm to society.

It ain't easy. And it sounds like he didn't punch her, he was trying to immobilize her (that's what throwing someone against a wall and on the ground is). It's her fault she was fighting back.

I'm not sure how many police officers or border control agents you're familiar with, but where I work (a full service police department with ~40 sworn officers working 4 ten-hour shifts per week), I've learned that police officers are some of the nicest people I've worked with.

They're sworn to protect and uphold the laws of this nation, and do so admirably. It's a serious job where there's not much time for joking around. Their job is to be alert 24 hours a day, and even MORE alert while they're in service. Sure, there are bad apples in this nation's law enforcement community...just like mutual fund managers and corporate executives come under scrutiny, police officers do too.

But to say that police officers have mental 'deficits' and as such are forced into careers in law enforcement is simply incorrect and untrue. If anything, you're the one with the intellectual shortcomings for assuming that 'beating up' a woman makes a man a pussy. Women can often be more dangerous than men to law enforcement officers because they're usually not regarded as security risks, and often act more brazen toward them without facing consequences.

Until you're familiar with what working in law enforcement is really like, I suggest you stop trolling this thread.

That stereotype just doesnt work. Asian girls, no matter if they are half the mass of the other person still kick butt. They can be more deadly than a typical police officer.

If she attacked the officer during any of this, he has a duty to put her down and cuff her. If she continues to resist, he has the legal right to use more force if necessary in order to cuff her. Attacking an officer is a fed crime anyways. If she had simply submitted when he questioned her, none of these bull would of happened.

The news sucks. If the "victim" was a white chick, it probably wouldnt have made the papers.

Im sure he didnt do it like in the movies and flip her head onto his knee. Its really easy to accidentally knee somebody, or elbow somebody when there is a struggle.

Not a direct example, but... If someone suddenly tickles you for example, even if you really dont mean it, there is a good chance one of your hinge joints can fly out and induce great pain on the other person.

Elbow maybe. The distance between the knee and another person's head too much to be a "joint flying out".

what would you feel if you went out for a morning jog, just to have the NYPD suspect that you are a gang leader, trips you onto the ground and mace you twice and kick you in the head?

if that NYPD asked me to stop for questioning first and then I didn't agree or ran, yeah, I'd expect that behavior, especially if I fought back.
