You obviously know nothing of what you speak. You can fire employees for out of work behavior. Subway will say he didnt get fired because he was gay (which would be descrimination) but because he starred in adult film (Pornstar is not a protected class of citizen). Reading comprehension FTL.

I already asked in this very thread if there was privacy issue, someone else said no.

That said, some people like to launch lawsuits anyway, maybe there'll be one - frivolous or not.

I honestly never understood why someone would want to force an employer to employ them, or a business onwer to do business with them.

That's kinda like forcing a GF/BF to date you.

If the employer is a homophobe, why would you want to work for him if you're gay?

And yes, my point extends to all forms of discrimination, protected or not. Why, if someone hated you, would you want to make that person money???

The initial threat was to the store, the franchise owner responded to it.

I'm not so sure the guy wants his job back now, but with that said I doubt employers mention that they are homophobic during job interviews, orientation or training.

Not really, an individual customer complained and said that the store would lose his business if they retained the employee.

I've heard this threat numerous times, even against my business, for a whole litany of idiotic reasons. We have a nice form letter/speech we give them with a smile as a polite "fuck you".

Had this been me I would have embarrassed the shit out of the customer using the knowledge that he himself would have to have closely watched said porn to identify the worker. But every owner runs their business differently so it was his call, even though I don't agree with it.

Extrapolate that a bit. Say you live in a small town with a big factory where almost everyone works. You need the job to support your family, but the owner doesn't like that you are X (race, religion, sexual preference, etc) so he fires you/won't hire you.

It's not that you want to work for a racist/bigot, you just want the job. Depending on where you live, every employer might have a similar bias. It's not reasonable to expect or force every person with a certain characteristic to leave a state or town to seek a job. It's simply a matter of practicality. And fairness.
