I think it fits the felony murder description. Someone dies as a result of a criminal act to which you are a party, you get charged just as if it were you that 'pulled the trigger.'
At a minimum, they'll use it as leverage to get him to plead guilty to a lesser charge.

This was a street race at 2AM. The crowd of people obviously showed up to watch the race. When I was young and stupid (or, at least, stupider) I used to go down and watch street races with my friend who had a riced up Civic. Cars would barrell down this little boulevard behind the airport at 110 MPH. I did think about what I would do if a car veered at me, and my plan was to jump. Yeah, honest to god. I probably would have been killed.
This is a social thing that these kids do, it's dangerous and stupid, and I'm not saying that there should be no punishment at all, but a murder charge is absolutely asinine.
I agree with that 100%. A person who is street racing or driving recklessly and kills an innocent bystander should absolutely be charged with murder. But in this case there were no innocent bystanders. Anyone there watching the race was participating in an illegal activity and willingly accepted the risks. Driver should lose his license forever, but a murder charge is stupid. The victims have the same level of blame as the driver does.
In California a person can be charged with their accomplice’s death if it occurs during the commission of a crime.

You realize that amount of power in a properly configured car (assuming a ~3500lb curb weight) would be running a quarter mile in the sevens, right?
Half that amount of power would have it running sub-10's.
Hell, the 03-04 Cobras with <$1000 in modifications (i.e. sticky tires and a smaller supercharger pulley) could touch the 11's. And that's faster than you're going to see any fucking car go on the street.

There is no way you can put '100k of mods' into a Mustang. You could rebuild the engine with forged everything, swap to a different engine, whatever, make as much power as you want, have 100% custom engine controls, 100% brand new suspension, ect; it still would not cost that amount.
Which says to me that the driver was clearly proven a fucking moron before he even got into the car. I have no sympathy for people who associated with him.
