WASHINGTON ― Deputy Attorney General Rod Rosenstein has appointed former FBI Director Robert Mueller to serve as special prosecutor overseeing the investigation into Russian influence in the 2016 presidential election.

In a statement, Rosenstein stressed that his decision “is not a finding that crimes have been committed or that any prosecution is warranted.” But he said he’d determined “based upon the unique circumstances, the public interest requires me to place this investigation under the authority of a person who exercises a degree of independence from the normal chain of command.”

The AG is not part of the Legislative Branch and therefore not subject to their approval. The DAG has the absolute legal right to appoint an independent counsel.

Now I need a splainer on DOJ special counsel powers vs. special prosecutor appointed by Congress. Not sure how comfortable I'd be knowing that technically this is the Administration's move, and not and independent branch of government's move.
 
Good. Let's get to the bottom of this and get it over with one way or another I am tired of hearing about it. Unless this guy is somehow considered a Trump pawn, I don't know.
 
Mueller is a solid choice. The righties will shit themselves trying to tie his relationship to Comey to him no that being qualified or impartial however.

The Congressional Special Prosecutor can no longer be invoked. The law allowing this expired in 1999 because of the Clinton investigation. Democrats didn't want a repeat. This leaves the DOJ to appoint someone who is answerable to the AG and can be terminated at any point. On the surface it would seem that Sessions can run the investigation but that is not true. Mueller will turn on him in a minute and we'd be in a Saturday Night Massacre situation. I believe Mueller is beyond reproach or manipulation.

Mueller, as FBI Director, along with Comey (then deputy AG) both threatened to resign over the Bush admin. overruling a DoJ finding that warrantless wiretapping was unconstitutional. What I like about that is not only was he on the right side of the issue, but he demonstrated a willingness to go against the sitting POTUS who nominated him for the job. That shows real independence.
 
There are reports out that The Dep. AG purposefully did this because he was so pissed that trump tried to throw him under the bus last week. He wanted to resurrect his reputation.
