There is what's legal and what is right. To be fair to the military, I highly doubt they're desperate enough for cannon fodder to prosecute a mom (which the article even states) who had already served and was discharged from her full active duty enlistment. If she had just not shown up, there probably would have been no consequences.

RALEIGH, N.C. ? The North Carolina mother who reported for Army duty with her two young children will be discharged from the military, her attorney said Monday. Attorney Mark Waple of Fayetteville said it wasn't yet clear if Lisa Pagan would receive an honorable discharge or a general discharge under honorable conditions. It also wasn't certain when she would be discharged.

The reason for the discharge will be that she doesn't have, and cannot have, an adequate family care for her two young children, he said.

Good deal. It only makes sense.

Her obligation is more to her family/kids now than to the military.

No, the only reasonable ending would have been if she had signed an MOS reduction contract to become non-deployable.

There is what's legal and what is right. I really don't have a problem with her being discharged as long as it is applied across the board to everyone. I still see this as a dodge though because her husband could have taken a different job.

This is my feeling.

She signed in for 8 years. 4x4.

The hubby's position in the civilian world should not have an impact on her status.
The hubby should have made arrangements for the children to be taken care off.

It was a voluntary pregnancy while she was on active duty.
The Ready Reserve is where you still draw pay - therefore you still have the obligations in force that you signed; unlike the inactive reserve where you draw no pay.

Well it's going to be the standard now. Any woman in a similar situation and a two cent lawyer can make a good claim that this should be universally applied

That should have been obvious for any thinking human being reading this thread, unfortunatnly you're not one of them.

I'm English, IN Afghanistan and i don't respect those who signed up but won't go. US soldiers are here, they share the same fund that she recieves money from and they hare here, she's not.

It's like refusing to go to work, wold you pay an employee that refuses to show up?
