So My Brother Got Into a Car Accident....

Well my brother went to LA this weekend without telling me or my parents. I found out the same night that he did from one of my friends and was a little worried something would happen since it was a long drive. Today, my brother called me and it seems that he hydroplaned his car going off an off ramp. He told me he wasn't speeding or anything and that he just lost control. Well, he hits the median on the freeway and somehow hits another car (i'm blurry about the details) which causes someone in the other car to have cuts on her arm. The cuts were pretty deep and she was taken to the hospital. My brothers car (RSX), had the bumper popped off and the front of his car is pushed in about a foot. It was towed away and is being stored there now. I have no experience with all of this and I tried to comfort my brother by telling him to call the place and figure out what he can do to get them to tow the car back to san jose. I know it's going to cost a lot but we just got it and we only have one way insurance (It also has a salvage title btw). I told him to find out what's up then call my dad and tell him ASAP. The worse part is, after I got off the phone, my parent's call me and tell me they are coming up to stockton to visit us and take us out to dinner..... I need some advice on our options (getting the car back or just selling the rest of it). ALso, the person who had her arm cut up was in a car that had a canadian license plate. I figure, we would have to pay for hospital bills since they don't have insurance to pay for anything from our hospitals.....sigh....I have 3 freakin midterms this week too......


Also, he is fine and it's a million times better that no one in his car got hurt (feel bad about other car though). I just want to hear suggestions from people that were in similiar circumstances.

It only covers damage that we do to the other car, not ours.

It rained in Stockon..So I don't know. He was going to Irvine and I'm not familiar with that area. I think he said he was on 33. No idea.

ETA - Just for fun, what year/make/model was your brother driving? What was the victim of the accident driving?

I work in Irvine. It definitely didn't rain on Friday in Irvine.

The CDN person may be covered by out of country insurance so I wouldnt be to concerned about that. The only problem is that if they are not covered by insurance, your bro may be liable for all the bills if it was his fault 100%.

Well, I can't really say what happened then what I heard from him. Which is that he was driving to irvine, hydroplaned and got into an accident. I wasn't really worried about if it was dry or not because either way he hit them and we only have one way liability so we are kind of in a pickle.

Your brother should get a lawyer and figure out the best way to approach your insurance company.

In Canada, all drivers must be insured 100% but whether they had out if country insurance that is a different story. Regardless, if your bro hit them and is 100% at fault, he will be liable for all costs incurred and if it gets sticky, the CDN's can opt to sue him for damages to the car, bills etc.

Hmmmm. You ask about getting the car back from the tow yard and yet you won't answer about the year/model/make of your brother's car. I could understand if you didn't know the year of the victim's car but you don't know the model/make either?

Are you sure you weren't the one actually driving the car?

Why sue him if the insurance will pay for the car damages and if they had insurance?

I said my bros car was an 04 RSX in the OP. I have no idea what the victims car was.
