They dont have to settle for the insurance figure that is presented to them, they have a choice to accept or sue if they feel that they are entitled more.

Yeah, me too. I'm not sure how badly hurt the other person was. My brother ran up to help her and such when the accident happened. He told me he could kind of see inside her arm and he felt totally sick about it (guilty, horrified, and everything).
Hmmmm. You ask about getting the car back from the tow yard and yet you won't answer about the year/model/make of your brother's car. I could understand if you didn't know the year of the victim's car but you don't know the model/make either?

No. You never said it was a 2004 in the OP. And I don't understand how your brother hasn't told 'you' what kind of car the victim had.

You mention the front of his car being pushed in. Maybe y'all should check to see how much it's worth and compare it with how much it would cost to get it fixed.

What your brother should be doing in the meantime is getting a job and/or a second job.

Alright, so i clarified stuff with him. he said it happened on I5 not in LA. So that's near here so towing won't be a problem.

Umm, I5 goes all the way down into socal, so it could be near you or it could be 400 miles from you.

How does it work with him hitting a canadian driver without insurance? I thought if he hit another californian without insurance, he wouldn't be liable or at fault because the other driver was on the road illegaly.

Well I already figured that we would do that. He just isn't in the position to go look for quotes since it just happened yesterday and he doesn't really have a means to drive around himself. Plus the car is up here and he's in Irvine now. Well, either way our insurance will pay for the other car so it doens't matter to an extent. I'm more scared about what they can do and how to prepare for it.

He was no where near Los Angeles then.

EDIT: Or he was coming back and took the scenic route.

EDIT #2: It's no doubt at the location in Los Banos. Salinas is on near the coast outside of Monterey, Oakhurst is about an hour north of Fresno on your way to Yosemite National Park.

Well, it's in your insurance company's lap now. Unless they reach the max that you're insured for (doubtful, with what you described), you should be OK. But your rates will almost certainly skyrocket after this.

So I take it the police report says that he's 100% at fault?

Yeah, I know and I'm trying. Just hard to concentrate when I know my parents are finding out tomorrow and all the hell that is going to break loose. Especially since I'm older ...I'm going to get chewed out..

Well, since he hit them because he lost control, I'm assuming he isn't 100%. I tend to over worry and assume he is 100% at fault just so that I'm not suprised by anything. It's one of my flaws. yeah, I looked up what my insurance will cover and it seems like they will cover anything up until a $30,000 law suit. Anything more than that we have to pay for. That is assuming we have the cheapest liability plan (I'm pretty sure my mom got the cheapest =/). So I'm less concerned about that for now. I just called my brother and told his ass to get the hell back to Stockton before my parents get here since they were supposed to visit. It's going to be o so much worse if he isn't here and he calls them about the accident. I can't believe he didn't call me and ran off to LA after getting into the accident, it only happened 1.5 hours away from where I was.....

Well if my little brother crashed his car I'd probably lay into him too, but the real whippin should come from the parents.

I don't know why they would get angry, they should do their job as parents, it's not your job to punish your younger brother, though as an older brother you should lay into him for being a dumbass.

Anyhow, I also think any parents that buys their kid a car and only gets them liability insurance is an idiot, if you're going to mess up at any point while driving it's most likely gonna be when you're a kid.

Depends probably on a number of factors, if your brother wasn't speeding, wasn't zigging and zagging in traffic and wasn't being an idiot. Probably none.

However cars don't plane for no reason.
