Varies from state-to-state, but very often if a lease expires without a new one being signed and the tennant isn't asked to leave, it goes month-to-month.

Even if it doesn't, you can't force a dude to let you stay in his home. No state magically entitles you to an extra year after the lease expires.

I understand you dont want to move but how do you figure there should be a law to make him..the landlord, the owner of the house, let you stay as long as you feel like it.

You didn't sign a lease because you thought it would be to your benefit..ie. if you found a new place youd be out of there leaving him high and dry ..yet when he needs you out all of a sudden you feel you should be protected by some california 'i aint ready to move out yet' law. why didnt you ask him for a lease as soon as the old one expired?

it doesnt make sense..sorry bud looks like you need to find a new place.

In most states, it does.

Either way, the nice thing to do (he wants his kids to move in?) is to go look for a place. He's being decent about this, so should you.

well if it was a 1 year lease that expired, he can get you now for tresspassing.

Stop being a whiney bitch, and move. $900 will cover any deposit on a 1 bedroom apt, plus setting up utilities.

The only reason i can see for you not wanting to move, is you are in a really good neighborhood, and you think you're better than you really are and don't want to live with us common folk,or you're banging his wife when he's at work.

Christ. Sounds like a good deal to me! Last place I leased, I didn't renew and the landlord told me I had 4 days to get out before the new tenants moved in.

It would be best to, at the very least, start looking at different places. Since he runs the place and apparently now there is no timed lease is in effect he could give you 2 weeks/1 months notice at anytime.

Where do you get that you have ANY rights on this? Your lease is month-to-month. He can give you 30-day notice any time he wants to.

IT'S HIS HOUSE! If his reasons to have you move is to paint the walls fuscia and start a nudist-rodeo colony he has every right to do so.

Take the $900 which he doesn't have to give you, take his 4-runner to move your stuff, and be happy that you have/had a nice landlord.

i'm gonna use the sec deposit for my final months rent and get the $900 from him..

Dude, you're missing the point completely. It is not your house. I'm the 99th person to say that. You're currently living there w/o a lease of any kind. You could come home from work and find all your crap stacked neatly at the curb and there wouldn't be a damn thing you could do about it, legally.

Take the $900, say "thanks and good luck" and smile and get teh hell out of Dodge. :)

He's going to keep your deposit b/c the house is "damaged" or the lawn "needs reseeding due to your fault" or any number of reasons scumbag landlords screw tenants.

It doesn't change ANYTHING about the fact that you must move out soon, or risk being homeless; but I'd ask him:

Hey, Sir? $900 to move out, right? Is that in addtion to my $1950 deposit that I'll be getting back?

$5 says he laughs in your face. :(

which means he respects you ... and ... you just might get your security back if you be civil about this...

I'd wash that bitter taste you got in your mouth away ,,, and tell the guy you be neat and orderly on your way out...

and you'll probably get your security back ... plus the 900 ...

(unless your rich and dont care)

i think i can use my deposit for Apr rent...and get the $900 from him..
need to cancel dsl, change phone...change add/phone for friggin everything...
he's coming on sunday with someone...he says from bank..about re-mortgage
or something...

i'll tell him then that i'll take his offer. :(
holy cow...the next 2mths will be painful...packing-o-rama...

No... come on dude, I know it sucks having to relocate, find a new place, etc. when your fine where you are... BUT, your Lanlord is being MORE than cool about this, sounds like a decent guy. He's not trying to leave you high and dry... he's gotta do what he's gotta do.
